【摘要】：自1971年Michael Hart啟動(dòng)古登堡計(jì)劃(Project Gutenberg),將《獨(dú)立宣言》文稿作為古登堡工程中的第一個(gè)二進(jìn)制編碼文件,制作出世界上第一本電子書以來,伴隨著科學(xué)技術(shù)和網(wǎng)絡(luò)技術(shù)的不斷發(fā)展,人們的閱讀方式已經(jīng)發(fā)生了歷史性的巨變。從2007年亞馬遜推出電子閱讀器kindle并開放電子書店,電子書閱讀熱潮開始在全球范圍內(nèi)興盛起來。電子書的出現(xiàn)改變了人們傳統(tǒng)的閱讀方式,人們的視線由紙質(zhì)書籍逐漸轉(zhuǎn)向電子書,并成為當(dāng)前人們生活中不可缺少的一種新型閱讀方式。然而,電子書的普及伴隨而來的是源源不斷的版權(quán)問題,各種版權(quán)糾紛日益凸顯。本文以我國電子書的版權(quán)問題作為主要研究對(duì)象,從電子書和版權(quán)的基本概念入手,結(jié)合百度文庫出現(xiàn)的版權(quán)問題案例,分析了我國電子書現(xiàn)存的版權(quán)問題,對(duì)如何應(yīng)對(duì)版權(quán)問題提出針對(duì)性建議和對(duì)策。總之,本文從分析出我國電子書版權(quán)在法律法規(guī)、版權(quán)技術(shù)、版權(quán)意識(shí)以及版權(quán)監(jiān)管等方面出現(xiàn)的問題,以百度文庫版權(quán)侵權(quán)事件為例,對(duì)電子書的版權(quán)問題提出合理建議,來促進(jìn)我國電子書產(chǎn)業(yè)的健康有序地發(fā)展。
[Abstract]:Since Michael Hart launched Project Gutenberg in 1971, (Project Gutenberg), has produced the world's first e-book, using the Declaration of Independence as the first binary code in the Gutenberg project. With the continuous development of science and technology and network technology, people's reading style has undergone a historic change. Since Amazon launched its e-reader kindle and opened its e-bookstore in 2007, the ebook reading boom has begun to flourish around the world. The emergence of e-books has changed the traditional way of reading, people's attention from paper books to e-books gradually, and become an indispensable new reading way in our daily life. However, the popularity of e-books is accompanied by a steady stream of copyright issues, various copyright disputes increasingly prominent. This paper takes the copyright problem of Chinese e-book as the main research object, starting with the basic concept of e-book and copyright, combining the case of copyright problem in Baidu library, analyzes the existing copyright problem of e-book in our country. To how to deal with copyright problems put forward targeted suggestions and countermeasures. In a word, this paper analyzes the problems of e-book copyright in our country in the aspects of laws and regulations, copyright technology, copyright consciousness and copyright supervision and so on. Taking the copyright infringement of Baidu library as an example, this paper puts forward some reasonable suggestions to the copyright problem of e-book. To promote the healthy and orderly development of China's e-book industry.
