【摘要】：博客作為最具代表性的新一代互聯(lián)網(wǎng)應(yīng)用之一,伴隨著互聯(lián)網(wǎng)的蓬勃發(fā)展而大行其道,在我國4.2億的網(wǎng)民之中有超過一半的人在使用博客。隨之而來的是涉及博客作品的著作權(quán)糾紛隨之不斷增多,博客作品著作權(quán)的保護(hù)問題被推上了網(wǎng)絡(luò)環(huán)境下著作權(quán)制度變革的風(fēng)口浪尖。著作權(quán)亦稱之為版權(quán),其權(quán)利因技術(shù)的進(jìn)步而誕生,其制度因技術(shù)的發(fā)展而完善,其保護(hù)卻因技術(shù)的變革而不斷陷入困境。在網(wǎng)絡(luò)時代,主體、客體、權(quán)利內(nèi)容、侵權(quán)行為和責(zé)任等等一切著作權(quán)的要素都變得陌生起來。尤其是科技發(fā)展導(dǎo)致博客作品極易復(fù)制和傳播,使得著作權(quán)的保護(hù)與公眾利益之間的平衡再次被打破。因此著作權(quán)法制體系亟待完善,明確權(quán)利,明確責(zé)任,重新建立起博客作品作者與公眾之間的利益平衡,實(shí)現(xiàn)對博客作品著作權(quán)的有效保護(hù)。 本文主要運(yùn)用演繹推理分析、比較分析、案例分析等方法,分四個部分對博客作品的著作權(quán)保護(hù)問題進(jìn)行了論述,指出了傳統(tǒng)著作權(quán)制度在互聯(lián)網(wǎng)環(huán)境下的不適應(yīng),對我國博客作品著作權(quán)保護(hù)制度的完善提出了自己的意見。 論文的第一部分,從基本概念入手,介紹了博客的起源,探討為什么如此之眾的網(wǎng)民選擇使用博客,并從三個方面分析了博客作品的出現(xiàn)給傳統(tǒng)著作權(quán)制度帶來的沖擊和影響。 第二部分簡要介紹了目前國內(nèi)外立法和國際條約中關(guān)于著作權(quán)制度的一般性規(guī)定,并重點(diǎn)研究了著作權(quán)立法因應(yīng)互聯(lián)網(wǎng)技術(shù)發(fā)展而做出的調(diào)整和變化。 第三部分研究了互聯(lián)網(wǎng)環(huán)境下,我國法律對博客作品著作權(quán)保護(hù)的缺陷。討論博客作品著作權(quán)與傳統(tǒng)著作權(quán)相比,包括主體、客體、權(quán)利內(nèi)容等等在內(nèi)的著作權(quán)諸要素內(nèi)涵的變化,以及使用現(xiàn)有傳統(tǒng)著作權(quán)立法保護(hù)博客作品著作權(quán)時的困境。該部分同時從合理使用制度的角度,分析了傳統(tǒng)著作權(quán)制度對網(wǎng)絡(luò)技術(shù)發(fā)展的不適應(yīng)狀態(tài)。 論文的第四部分將落腳點(diǎn)放在了我國博客作品著作權(quán)保護(hù)制度的完善上。從完善立法模式、完善法制體系、發(fā)展權(quán)利集體管理制度、改進(jìn)合理使用制度和促進(jìn)默示許可制度等五個方面,力爭為我國著作權(quán)制度的調(diào)整提出可行性較強(qiáng)的建議。
[Abstract]:Blog as one of the most representative new generation of Internet applications, along with the rapid development of the Internet, more than half of the 420 million Internet users in China are using blogs. With the increasing of copyright disputes involving blog works, the protection of the copyright of blog works has been pushed to the forefront of the reform of copyright system under the network environment. Copyright is also called copyright, its right is born by the progress of technology, its system is improved by the development of technology, but its protection is constantly in trouble because of the technological change. In the age of network, subject, object, right content, tort and liability all the elements of copyright become unfamiliar. Especially because of the development of science and technology, blog works are easy to be copied and disseminated, and the balance between copyright protection and public interest is broken again. Therefore, the system of copyright law needs to be perfected, to make clear the rights and responsibilities, to re-establish the balance of interests between the author of blog works and the public, and to realize the effective protection of the copyright of blog works. This paper mainly uses deductive reasoning analysis, comparative analysis, case analysis and other methods to discuss the copyright protection of blog works in four parts, and points out that the traditional copyright system is not suitable for the Internet environment. The author puts forward his own opinions on the perfection of copyright protection system of blog works in China. In the first part, the author introduces the origin of blog, discusses why so many netizens choose to use blog, and analyzes the impact and influence of blog works on the traditional copyright system from three aspects. The second part briefly introduces the general provisions of copyright system in domestic and foreign legislation and international treaties, and focuses on the adjustment and change of copyright legislation in response to the development of Internet technology. The third part studies the defects of the copyright protection of blog works in the internet environment. This paper discusses the changes of the connotation of copyright elements of blog works, including subject, object, content of rights and so on, compared with traditional copyright, and the predicament of using the existing traditional copyright legislation to protect the copyright of blog works. At the same time, from the point of view of rational use system, this part analyzes the inadaptability of traditional copyright system to the development of network technology. The fourth part of the thesis puts its foothold on the perfection of copyright protection system of blog works in China. From the five aspects of perfecting the legislative model, perfecting the legal system, developing the system of collective management of rights, improving the system of rational use and promoting the implied license system, the author tries to put forward some feasible suggestions for the adjustment of the copyright system in our country.
