論教輔圖書的著作權(quán)保護(hù)

【摘要】:著作權(quán)是指著作權(quán)人依法對(duì)其創(chuàng)作的作品所享有獨(dú)占、使用和處理的權(quán)利。近年來關(guān)于教輔圖書著作權(quán)的糾紛案件愈演愈烈,尤其是教輔與教材之間的侵權(quán)糾紛層出不窮,反映出了我國(guó)對(duì)教輔圖書著作權(quán)保護(hù)的不足,加強(qiáng)對(duì)教輔圖書著作權(quán)保護(hù)迫在眉睫。因此,本文的研究具有重大的理論意義和實(shí)踐意義。首先,通過本論文的研究,旨在探究教輔擁有的著作權(quán)利,從而促進(jìn)我國(guó)知識(shí)產(chǎn)權(quán)法,尤其是著作權(quán)法對(duì)教輔圖書相應(yīng)權(quán)利的保護(hù)。其次,通過本論文的研究,完善關(guān)于教輔圖書著作權(quán)法的法律法規(guī)。再次,通過本論文的研究,促進(jìn)教輔圖書維權(quán)和教輔圖書版權(quán)意識(shí)的提高。再次,通過本論文的研究,有利于法院在審理案件的過程中,充分考慮教輔圖書這一著作權(quán)保護(hù)的特殊性,為案件的科學(xué)審判提供借鑒性的指導(dǎo)。最后,通過本論文的研究,使出版商清晰認(rèn)知自身權(quán)利邊界和自身合法性的邊界,充分發(fā)揮市場(chǎng)競(jìng)爭(zhēng)機(jī)制,促進(jìn)我國(guó)圖書業(yè)的繁榮發(fā)展。本文通過運(yùn)用文獻(xiàn)分析方法、實(shí)證分析方法、比較分析方法等研究方法,就教輔圖書著作權(quán)存在的問題、教輔圖書著作權(quán)的權(quán)利內(nèi)容、教輔圖書著作權(quán)的保護(hù)措施進(jìn)行了逐一分析。全文共分為七個(gè)部分: 第一部分:引言。從人民教育出版社發(fā)表的一段聲明引出教輔圖書著作權(quán)保護(hù)的迫切性和必要性。 第二部分:教輔圖書的著作權(quán)糾紛。通過對(duì)“北京仁愛訴中學(xué)教輔-案”的評(píng)析,探究教軸圖書與教材的著作權(quán)關(guān)系。 第三部分:教輔圖書著作權(quán)保護(hù)中存在的問題及癥結(jié)。分析了當(dāng)前教輔圖書著作權(quán)保護(hù)中面臨的一些問題及產(chǎn)生這些問題的原因。 第四部分:教輔圖書著作權(quán)保護(hù)的權(quán)利基礎(chǔ)。揭示了教輔圖書的法律屬性和教輔圖書著作權(quán)的產(chǎn)生。 第五部分:教輔圖書的著作權(quán)保護(hù)。闡述了教輔圖書的權(quán)利內(nèi)容和各個(gè)權(quán)利主體擁有的著作權(quán)利。 第六部分:對(duì)教輔圖書著作權(quán)保護(hù)的完善。筆者針對(duì)教輔圖書著作權(quán)保護(hù)中的不足,提出了教輔圖書著作權(quán)保護(hù)的一些措施。 第七部分:結(jié)語。筆者期待教輔圖書的著作權(quán)保護(hù)在今后的立法和司法實(shí)踐中取得長(zhǎng)足的發(fā)展。
[Abstract]:Copyright refers to the copyright owner's exclusive right to use and deal with the works he creates according to law. In recent years, the disputes about the copyright of teaching auxiliary books are becoming more and more serious, especially the infringement disputes between teaching aids and teaching materials emerge in endlessly, which reflects the deficiency of copyright protection of teaching auxiliary books in our country. It is urgent to strengthen the copyright protection of teaching auxiliary books. Therefore, the study of this paper has great theoretical and practical significance. First of all, through the research of this paper, the purpose of this paper is to explore the copyright rights of the teaching aids, so as to promote the protection of the corresponding rights of the teaching auxiliary books in China's intellectual property law, especially the copyright law. Secondly, through the study of this paper, improve the copyright law of teaching-assisted books laws and regulations. Thirdly, through the research of this paper, it promotes the rights protection and copyright consciousness of teaching auxiliary books. Thirdly, through the research of this paper, it is helpful for the court to consider the particularity of the copyright protection of teaching auxiliary books in the process of hearing cases, and to provide reference guidance for the scientific trial of cases. Finally, through the research of this paper, the publishers can clearly understand the boundary of their own rights and their own legitimacy, give full play to the market competition mechanism, and promote the prosperity and development of China's book industry. By using the methods of literature analysis, empirical analysis, comparative analysis and other research methods, this paper discusses the problems existing in the copyright of teaching auxiliary books, and the content of copyright rights of teaching auxiliary books. The measures to protect the copyright of teaching auxiliary books are analyzed one by one. The full text is divided into seven parts: the first part: introduction. From a statement issued by the people's Education Publishing House, the urgency and necessity of copyright protection for teaching auxiliary books are drawn. The second part: the copyright dispute of teaching assistant books. Through the analysis of Beijing benevolence v. secondary school teaching aid case, this paper explores the copyright relationship between teaching books and teaching materials. The third part: the problems and sticking points in the copyright protection of teaching-assisted books. This paper analyzes some problems in the copyright protection of teaching auxiliary books and the reasons for these problems. The fourth part: the right foundation of copyright protection of teaching auxiliary books. It reveals the legal attribute of the teaching assistant books and the creation of the copyright of the teaching auxiliary books. Part five: copyright protection of teaching assistant books. This paper expounds the content of the right of teaching auxiliary books and the rights of each right subject. The sixth part: the perfection of copyright protection of teaching auxiliary books. Aiming at the deficiency of copyright protection of teaching auxiliary books, the author puts forward some measures to protect the copyright of teaching auxiliary books. Part seven: conclusion. The author expects the copyright protection of teaching auxiliary books to make great progress in legislation and judicial practice in the future.
