【摘要】：版權(quán)登記制度是指作者或者其他權(quán)利人將版權(quán)權(quán)利變更的事實向法律規(guī)定的國家機關(guān)提出申請,該法定機關(guān)根據(jù)申請進行審查,審查通過之后將這種事實登記于國家機關(guān)的專門薄上的一種法律制度。設(shè)立該制度的宗旨是為了更好地維護版權(quán)交易安全,維護版權(quán)人的合法權(quán)益。版權(quán)的權(quán)利變更包括版權(quán)的轉(zhuǎn)讓、質(zhì)押、許可使用等內(nèi)容,在《著作權(quán)質(zhì)押合同登記辦法》和《擔(dān)保法》中對版權(quán)質(zhì)押登記的規(guī)定已較為成熟。在2001年修正的《著作權(quán)法》中規(guī)定了版權(quán)財產(chǎn)權(quán)可以轉(zhuǎn)讓,卻沒有相關(guān)法律規(guī)定版權(quán)轉(zhuǎn)讓登記制度,導(dǎo)致版權(quán)交易市場“一權(quán)多賣”的事件頻頻發(fā)生,即版權(quán)人先后與多人簽訂合同,將版權(quán)中的財產(chǎn)權(quán)部分先后轉(zhuǎn)讓給多個受讓人而產(chǎn)生的版權(quán)爭議糾紛。作品的“一權(quán)多賣”往往使未取得權(quán)利的受讓人利益受到損害,在版權(quán)交易的過程中,需要有一定的方式表征版權(quán)的權(quán)屬狀態(tài)以消除上述現(xiàn)象的出現(xiàn)。當(dāng)今大多數(shù)國家都已經(jīng)建立的版權(quán)登記制度,只是在具體的制度設(shè)計上有所不同。由于我國法律缺乏對版權(quán)登記制度的規(guī)定,導(dǎo)致實踐中版權(quán)登記出現(xiàn)版權(quán)登記效力不明確、登記機關(guān)和程序不統(tǒng)一等問題。因此,我國應(yīng)當(dāng)在《著作權(quán)法》中增加版權(quán)登記的原則性規(guī)定,統(tǒng)一登記機關(guān),明確登記的效力,規(guī)范版權(quán)登記的具體內(nèi)容,并建立版權(quán)登記的輔助登記制度。
[Abstract]:Copyright registration system refers to a legal system in which an author or other obligee applies to a state organ for the facts of a change in copyright. The statutory organ examines the application and registers the facts on a special book of a state organ after examination and approval. The purpose of the system is to make it better. To safeguard the security of copyright transactions and the legitimate rights and interests of copyright owners, copyright alterations include the transfer, pledge and licensing of copyright. The provisions on the registration of copyright pledge in the Measures for Registration of Copyright Pledge Contracts and the Guarantee Law are relatively mature. However, there is no registration system for the transfer of copyright, which leads to frequent occurrences of "one right to sell more" in the copyright trading market. That is, copyright owners have signed contracts with many people to transfer part of the property rights in the copyright to multiple transferees, resulting in copyright disputes. In the process of copyright transaction, there is a need to characterize the ownership of copyright in order to eliminate the above phenomenon. Most countries have established the copyright registration system, but the specific system design is different. Therefore, China should add the principle of copyright registration to the Copyright Law, unify the registration authorities, clarify the effectiveness of registration, standardize the specific content of copyright registration, and establish an auxiliary registration system for copyright registration.
