【摘要】：隨著社會的不斷進步，我們周圍的網絡環(huán)境也在發(fā)生著翻天覆地的變化。由于網絡的普及，侵犯版權的行為越來越多樣化，傳統(tǒng)的版權法已經不能很好的保護版權人的利益了。社會各界對網絡服務商產生版權間接侵權責任的討論也越來越多，版權間接侵權制度的出臺勢在必行。 由于法律規(guī)制的不完善，我國在處理網絡服務商侵權問題時主要還是依靠《民法通則》關于共同侵權的條款和《信息網絡傳播權保護條例》的相關規(guī)定來解決，在《侵權責任法》實施之后，雖然當中有專門對網絡服務商侵權的規(guī)定，但是因為內容過于抽象，在適用時效果不是太理想，因而導致實務中很多問題不能得到公平有效的解決，使得網絡環(huán)境下如何分配服務商的責任成為一個棘手的問題。 本文先從分析間接侵權責任產生的原因入手，強調構建版權間接侵權制度的必要性，之后引用大量英美法系相關的法律和判例對版權間接侵權的概念加以明晰。同時，本文結合近幾年國內一些著名的網絡服務商版權侵權的案件引出國內立法方面的不足并加以分析。通過案件的分析，可以看出雖然我們沒有制定版權間接侵權的規(guī)則，但是實務中卻經常會用到間接侵權的相關概念。 本文在前人探討的基礎之上，，對幾種網絡上比較常見的服務商加以討論，通過對他們不同功能的分析得出五種不同的網絡服務商類型，并對每種網絡服務商的責任構成進行討論分析，希望能夠在制定出網絡服務商版權間接侵權一般責任條款的基礎之上，對每種網絡服務商都有各自特定的要求，完善間接侵權制度。
[Abstract]:With the continuous progress of society, the network environment around us is also taking place earth-shaking changes. Due to the popularity of the network, copyright infringement is becoming more and more diverse, traditional copyright law has not been able to protect the interests of copyright owners. There are more and more discussions about indirect copyright infringement liability of network service providers, and it is imperative to introduce the system of indirect copyright infringement. Due to the imperfection of legal regulation, our country mainly relies on the joint tort provisions of "General principles of Civil Law" and the relevant provisions of "Protection of Information Network Transmission right" when dealing with the infringement of network service providers. After the implementation of the Tort liability Law, although there are specific provisions for infringement of network service providers, because the content is too abstract, the effect is not too good when applied. As a result, many problems in practice can not be solved fairly and effectively, which makes it a thorny problem how to distribute the responsibility of service providers in the network environment. This paper begins with the analysis of the causes of indirect tort liability, emphasizes the necessity of constructing the system of indirect copyright infringement, and then makes clear the concept of indirect copyright infringement by quoting a large number of relevant laws and precedents in common law systems. At the same time, combined with some famous copyright infringement cases of network service providers in China in recent years, this paper leads to the shortcomings of domestic legislation and analyzes them. Through the analysis of cases, we can see that although we do not make the rules of indirect copyright infringement, we often use the concept of indirect infringement in practice. On the basis of the previous discussions, this paper discusses several common service providers on the network, and obtains five different types of network service providers through the analysis of their different functions. And discuss and analyze the liability constitution of each kind of network service provider, hope that on the basis of making out the general liability clause of indirect infringement of copyright of network service provider, each kind of network service provider has its own specific requirements. Improve the system of indirect infringement.
