【摘要】：當(dāng)前,新媒體未經(jīng)許可轉(zhuǎn)載紙媒新聞作品的現(xiàn)象大量存在,直接妨害了紙媒的生存與發(fā)展,"新聞無(wú)版權(quán)"則是這種現(xiàn)象出現(xiàn)的重要根源。實(shí)際上,"新聞無(wú)版權(quán)"是對(duì)法律的誤讀,紙媒的內(nèi)容生產(chǎn)在我國(guó)著作權(quán)法上受到嚴(yán)格保護(hù),只有單純事實(shí)消息被排除在著作權(quán)保護(hù)范疇之外,而凝聚了紙媒獨(dú)特創(chuàng)造性勞動(dòng)的深度報(bào)道、調(diào)查性報(bào)道、言論等均可獲得版權(quán)保護(hù);此外,我國(guó)法律對(duì)新媒體使用享有著作權(quán)的作品有嚴(yán)格限制,新媒體不能通過(guò)合理使用、法定許可等形式任意使用紙媒的內(nèi)容,必須獲得紙媒的許可才能使用其內(nèi)容。在法律框架內(nèi),紙媒可以采用獲取著作權(quán)、宣示權(quán)利、權(quán)利救濟(jì)的合法路徑,最大限度保護(hù)自身的版權(quán),并在實(shí)踐中從生存前景重于經(jīng)濟(jì)收益的考量出發(fā),積極針對(duì)各種著作權(quán)侵權(quán)行為尋求法律、行政方面的救濟(jì),最大限度消除新媒體對(duì)紙媒獨(dú)有信息內(nèi)容的無(wú)償、廉價(jià)侵蝕,為紙媒在媒體競(jìng)爭(zhēng)中挽回頹勢(shì)增添有力的砝碼。
[Abstract]:At present, the phenomenon of new media reprinting print news works without permission exists in large quantities, which directly hinders the survival and development of paper media. "News without copyright" is an important source of this phenomenon. In fact, "News without copyright" is a misreading of the law. The content production of print media is strictly protected in the copyright law of our country, and only simple factual information is excluded from the scope of copyright protection. In addition, the law of our country has strict restrictions on the use of copyright works by new media, and new media cannot be used reasonably. In order to use the content of paper media, we must obtain the permission of the paper media to use the content freely in the form of legal permission. Within the framework of the law, the paper media can adopt the legal way of obtaining copyright, declaring rights and right relief, and protecting their own copyright to the maximum extent. In practice, they can consider the survival prospect more than the economic benefits. Actively seeking legal and administrative relief for all kinds of copyright infringement, eliminating the free and cheap erosion of the exclusive information content of the new media to the greatest extent, adding a powerful weight for the paper media to recover the decline in the media competition.
