【摘要】： 我國(guó)《著作權(quán)法》確立作者享有信息網(wǎng)絡(luò)傳播權(quán)后,《信息網(wǎng)絡(luò)傳播權(quán)保護(hù)條例》具體細(xì)化了信息網(wǎng)絡(luò)傳播權(quán)保護(hù)制度。我國(guó)對(duì)信息網(wǎng)絡(luò)傳播權(quán)的保護(hù),具有自身的特點(diǎn)。本文從維護(hù)權(quán)利人合法權(quán)益的角度,對(duì)我國(guó)網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)以及版權(quán)保護(hù)展開研究。 本文主要從四個(gè)方面展開論文的研究與寫作。第一部分,在對(duì)目前我國(guó)網(wǎng)絡(luò)發(fā)展進(jìn)行綜述的基礎(chǔ)上,提出在現(xiàn)行法律體系下,如何保護(hù)與網(wǎng)絡(luò)環(huán)境下作者的版權(quán),以及探討有關(guān)版權(quán)保護(hù)制度設(shè)計(jì)中存在的問題。第二部分,對(duì)網(wǎng)絡(luò)環(huán)境下版權(quán)的內(nèi)涵以及版權(quán)侵權(quán)的各種形式作出解釋。目前我國(guó)信息網(wǎng)絡(luò)傳播涉及網(wǎng)絡(luò)復(fù)制、網(wǎng)絡(luò)發(fā)行、網(wǎng)絡(luò)傳播等,筆者在此基礎(chǔ)上對(duì)網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)的各種形式展開研究。第三部分,通過對(duì)當(dāng)前我國(guó)網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)行為的認(rèn)定,分別就有關(guān)版權(quán)侵權(quán)行為的管轄、侵權(quán)行為的構(gòu)成、侵權(quán)行為的第三方責(zé)任展開論述。第四部分,通過對(duì)網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)行為現(xiàn)狀與原因的分析,找到當(dāng)前我國(guó)網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)行為泛濫的原因,從而嘗試著為保護(hù)權(quán)利人的版權(quán)利益提出一些法律救濟(jì)建議。
[Abstract]:After the copyright Law of our country established that the author enjoys the right of information network communication, the "regulations on the Protection of the right of Information Network Communication" concretely refined the protection system of the right of information network communication. The protection of information network communication right in our country has its own characteristics. From the angle of protecting the legitimate rights and interests of the right holders, this paper studies copyright infringement and copyright protection in the network environment of our country. This paper mainly carries out the research and writing of the thesis from four aspects. The first part, on the basis of summarizing the development of network in our country, puts forward how to protect the author's copyright under the current legal system and discusses the problems existing in the design of copyright protection system. The second part explains the connotation of copyright and various forms of copyright infringement. At present, information network communication in China involves network replication, network distribution, network communication and so on. On this basis, the author studies various forms of copyright infringement under the network environment. The third part, through the recognition of copyright infringement under the current network environment, discusses the jurisdiction, the constitution and the third party liability of copyright infringement respectively. The fourth part, through the analysis of the current situation and reasons of copyright infringement under the network environment, find out the reason of the copyright infringement overflowing under the current network environment in our country. In order to protect the copyright interests of the right-holders to put forward some legal remedies.
