【摘要】：著作權(quán)合理使用制度是著作權(quán)領(lǐng)域一項(xiàng)重要的制度,是除作者外的他人能夠正當(dāng)?shù)氖褂米髌返谋Ｕ�。合理使用制度肩�?fù)著平衡著作權(quán)人、使用者和社會(huì)公眾三方利益的重任,是著作權(quán)法內(nèi)在的平衡精神內(nèi)涵的體現(xiàn)。著作權(quán)合理使用制度經(jīng)歷了很長(zhǎng)的歷史發(fā)展,每一次科技的更新都促使著法律的調(diào)整,而法律的調(diào)整也能反過(guò)來(lái)促進(jìn)技術(shù)的發(fā)展。放眼現(xiàn)在,網(wǎng)絡(luò)科技已經(jīng)滲透進(jìn)公眾生活的每一個(gè)角落,網(wǎng)絡(luò)著作權(quán)應(yīng)運(yùn)而生。當(dāng)合理使用制度遭遇網(wǎng)絡(luò)所催生的網(wǎng)上瀏覽、暫時(shí)復(fù)制、遠(yuǎn)程教育、數(shù)字圖書(shū)館和技術(shù)保護(hù)措施等新情況時(shí),不禁引發(fā)我們思考：合理使用制度如何向網(wǎng)絡(luò)延伸?如何繼續(xù)發(fā)揮其平衡著作權(quán)人、使用者和公眾利益的作用?能否應(yīng)對(duì)網(wǎng)絡(luò)科技給現(xiàn)有法律制度帶來(lái)的沖擊和挑戰(zhàn)? 要研究這些問(wèn)題,首先必須從明確網(wǎng)絡(luò)著作權(quán)合理使用制度的概念和特征等基本內(nèi)容出發(fā),進(jìn)而結(jié)合網(wǎng)絡(luò)的特殊性來(lái)分析網(wǎng)絡(luò)著作權(quán)合理使用制度面臨的沖擊。然后探討國(guó)內(nèi)外關(guān)于網(wǎng)絡(luò)著作權(quán)合理使用制度的立法現(xiàn)狀,通過(guò)比較分析的方法找出我國(guó)法律中的缺陷和不足之處。最后根據(jù)上述研究歸納總結(jié),從立法模式、判斷標(biāo)準(zhǔn)兩個(gè)主要方面做總體的建議,并針對(duì)網(wǎng)上瀏覽、暫時(shí)復(fù)制、遠(yuǎn)程教育和數(shù)字圖書(shū)館,以及技術(shù)保護(hù)措施各個(gè)方面給出具體的建議。
[Abstract]:The system of fair use of copyright is an important system in the field of copyright. The rational use system shoulders the important task of balancing the interests of copyright owners, users and the public, and it is the embodiment of the inherent spirit of balance in copyright law. The system of fair use of copyright has experienced a long history. Every update of science and technology promotes the adjustment of law, and the adjustment of law can also promote the development of technology. Now, network technology has penetrated into every corner of public life, network copyright came into being. When the system of rational use encounters the new conditions of Internet browsing, temporary replication, distance education, digital library and technology protection, we can not help thinking: how can the rational use of the system extend to the network? How to continue to play its role in balancing the interests of copyright owners, users and the public? Can we cope with the impact and challenges brought by network technology to the existing legal system? In order to study these problems, we must first clarify the concept and characteristics of the fair use of network copyright, and then combine the particularity of the network to analyze the impact of the fair use of network copyright. Then it probes into the domestic and foreign legislation on the reasonable use of network copyright, and finds out the defects and deficiencies of our country's laws by means of comparative analysis. Finally, according to the above research summary, from the legislative model, judging standard two main aspects of the overall recommendations, and for online browsing, temporary replication, distance education and digital library, And various aspects of technical protection measures to give specific suggestions.
