【摘要】：上海書業(yè)公會是上海地區(qū)書業(yè)自籌自建,以維護(hù)同業(yè)公益,矯正行業(yè)弊病為活動宗旨的同業(yè)公會組織。該組織于1905年至1958年間延續(xù)活動,在書業(yè)界有廣泛影響,但是學(xué)界并未給予相應(yīng)的重視。筆者僅選取1905年至1937年一段,就組織的版權(quán)維護(hù)活動為中心進(jìn)行考察,旨在窺探民間同業(yè)公會組織于維護(hù)版權(quán)方面的運作狀況,探討其成敗得失。 本文正文共五部分： 第一部分,主要介紹上海書業(yè)公會興起的社會背景及組織沿革。出版業(yè)的近代化及民營出版業(yè)的崛起,使近代書業(yè)同業(yè)公會組織的產(chǎn)生成為時代需要,而近代版權(quán)意識的萌生,則促使書業(yè)界的領(lǐng)軍——上海書業(yè)公會在其存在期間,一直將維護(hù)版權(quán)作為組織的主要活動內(nèi)容之一。 第二部分,介紹上海書業(yè)公會主要的版權(quán)維護(hù)活動。為維護(hù)版權(quán),上海書業(yè)公會制度建設(shè)與組織建設(shè)并重,積極協(xié)調(diào)同業(yè)版權(quán)糾紛,協(xié)助同業(yè)查究偽版,對政府版權(quán)立法、地方著作權(quán)事務(wù)以及涉外版權(quán)活動,都積極參與,充分發(fā)揮其主動性。 第三部分,就上海書業(yè)公會為維護(hù)版權(quán)與同業(yè)及政府間的交涉作分析。作為業(yè)界領(lǐng)袖,上海書業(yè)公會積極溝通、聯(lián)合同業(yè),共同致力于維護(hù)版權(quán)；作為中間組織,上海書業(yè)公會積極活動于政府與書業(yè)界之間,為同業(yè)利益積極奔走,爭取出版權(quán)益。 第四部分,就查究偽版委員會及駐平辦事處為個案,窺探組織在維護(hù)版權(quán)方面的活動開展及經(jīng)費收支情況,評析其活動效果。 第五部分,就上海書業(yè)公會的版權(quán)維護(hù)活動做簡要評析。作為同業(yè)間、同業(yè)與政府間溝通的平臺,上海書業(yè)公會致力于版權(quán)維護(hù)的努力,順應(yīng)了時代的需求,也維護(hù)了同業(yè)的利益。該組織在維護(hù)版權(quán)活動中所體現(xiàn)的尷尬,也啟示當(dāng)下的版權(quán)維護(hù)需要行業(yè)組織積極性法的更大發(fā)揮,同時,政府對維護(hù)版權(quán)也當(dāng)擔(dān)負(fù)起應(yīng)有的責(zé)任。
[Abstract]:Shanghai Book Guild is a self-organized trade association in Shanghai, which aims at maintaining the commonweal and correcting the maladies of the industry. The organization continued its activities from 1905 to 1958 and had extensive influence in the book industry, but the academic circles did not pay attention to it. The author chooses only one section from 1905 to 1937 to investigate the copyright maintenance activities of the organization. The purpose of this study is to probe into the operation of the folk trade association in the protection of copyright and to discuss its success or failure. There are five parts in the text: The first part mainly introduces the social background and organizational evolution of Shanghai Book Industry Association. With the modernization of the publishing industry and the rise of the private publishing industry, the emergence of the modern book trade association has become the need of the times, and the emergence of the modern copyright consciousness has prompted the book industry leader, the Shanghai Book Industry Guild, during its existence. Copyright protection has always been one of the main activities of the organization. The second part introduces the main copyright protection activities of Shanghai Book Industry Association. In order to protect copyright, the Shanghai Book Industry Association pays equal attention to the construction of the system and the organization, actively coordinates the copyright disputes in the same trade, assists the industry in the investigation of fake editions, and actively participates in government copyright legislation, local copyright matters and foreign copyright activities. Give full play to its initiative. In the third part, the author analyzes the negotiations between Shanghai Book Industry Association and its counterparts and governments for copyright protection. As an industry leader, the Shanghai Book Industry Association actively communicates, associates with the same industry and works together to protect copyright; as an intermediate organization, the Shanghai Book Industry Association actively acts between the government and the book industry, actively works for the interests of the industry and strives for publishing rights. In the fourth part, the investigation of the fake edition committee and the office in Pingping as a case, to explore the activities of the organization in the copyright protection activities and the income and expenditure situation, and evaluate the effectiveness of its activities. The fifth part makes a brief comment on the copyright protection activities of Shanghai Book Industry Association. As a platform for communication between the industry and the government, the Shanghai Book Industry Association devotes itself to the protection of copyright, conforms to the needs of the times and protects the interests of the same industry. The embarrassment of the organization in the copyright protection activities also reveals that the current copyright protection needs to be brought into greater play by the positive laws of trade organizations. At the same time, the government should shoulder its due responsibility for the protection of copyright.
