【摘要】：網(wǎng)絡(luò)分享下電視節(jié)目模板的版權(quán)保護(hù)面對(duì)著前所未有的困境和難題,相對(duì)于傳統(tǒng)的電視節(jié)目制作和播出環(huán)境,網(wǎng)絡(luò)平臺(tái)從節(jié)目制作的主體、視頻節(jié)目的內(nèi)容形態(tài)到視頻節(jié)目的傳播方式都發(fā)生了翻天覆地的變化。面對(duì)網(wǎng)絡(luò)平臺(tái)花樣百出的節(jié)目模板侵權(quán)行為,電視節(jié)目模板的版權(quán)擁有者無(wú)論是對(duì)版權(quán)重新界定,還是對(duì)權(quán)益的司法追訴,都不得不適應(yīng)新的環(huán)境和語(yǔ)境。本文選擇場(chǎng)域理論作為研究視角,從電視節(jié)目模板生成和運(yùn)行的場(chǎng)域、網(wǎng)絡(luò)分享場(chǎng)域的電視節(jié)目模板的新特征、網(wǎng)絡(luò)分享環(huán)境下的節(jié)目模板侵權(quán)、節(jié)目模板網(wǎng)絡(luò)分享侵權(quán)行為的追訴和網(wǎng)絡(luò)分享中的版權(quán)保護(hù)等個(gè)五個(gè)層面來(lái)探究網(wǎng)絡(luò)分享環(huán)境下電視節(jié)目模板版權(quán)保護(hù)機(jī)制的建構(gòu)路徑。
[Abstract]:The copyright protection of TV program template under the network sharing is facing unprecedented difficulties and difficulties. Compared with the traditional television program production and broadcast environment, the network platform starts from the main body of program production. The content form of the video program to the transmission mode of the video program has undergone earth-shaking changes. In the face of the infringing behavior of the network platform, the copyright owner of TV program template has to adapt to the new environment and context, whether it is the redefinition of copyright or the judicial prosecution of rights and interests. This paper selects the field theory as the research angle, from the television program template generation and the running field, the network sharing field television program template new characteristic, under the network sharing environment program template infringement, This paper probes into the construction path of the copyright protection mechanism of TV program template under the network sharing environment from five aspects: the prosecution of the infringement of the network sharing and the copyright protection in the network sharing.
