【摘要】:在我國網(wǎng)絡(luò)游戲著作權(quán)侵權(quán)案件的判定中,由于案件的復(fù)雜多變,認(rèn)定網(wǎng)絡(luò)游戲的作品屬性是一個(gè)難題。而當(dāng)網(wǎng)絡(luò)游戲的構(gòu)成要素被抄襲或遭遇其他著作權(quán)侵權(quán)問題時(shí),如何對這些要素進(jìn)行作品屬性認(rèn)定,在現(xiàn)實(shí)中需要亟待解決。本文通過對網(wǎng)絡(luò)游戲進(jìn)行分類,從網(wǎng)絡(luò)游戲的設(shè)計(jì)和開發(fā)的角度將不同類型的網(wǎng)絡(luò)游戲進(jìn)行構(gòu)成要素的抽象性分析,然后對這些要素進(jìn)行歸納和總結(jié),總結(jié)出網(wǎng)絡(luò)游戲可能具備的一般性要素,繼而對這些一般性要素屬于思想還是表達(dá)進(jìn)行理論研究,總結(jié)出屬于表達(dá)的要素,對這些表達(dá)要素的獨(dú)創(chuàng)性判定進(jìn)行闡述。論文共分為五個(gè)部分:首先介紹了司法實(shí)踐中比較具有代表性的兩則案例;第二部分對網(wǎng)絡(luò)游戲著作權(quán)的侵權(quán)現(xiàn)狀和侵權(quán)類型進(jìn)行總結(jié),由此引出針對網(wǎng)絡(luò)游戲著作權(quán)侵權(quán)的理論分歧;第三部分是論文的主體部分,在對網(wǎng)絡(luò)游戲的分類進(jìn)行分析后,對不同分類的要素進(jìn)行探究和抽象化,總結(jié)出網(wǎng)絡(luò)游戲的一般性要素,然后將這些要素與著作權(quán)法的基本理論結(jié)合,將屬于表達(dá)的要素總結(jié)后,進(jìn)行獨(dú)創(chuàng)性標(biāo)準(zhǔn)的研究,在對該部分總結(jié)后,利用得出的理論對評析案例;第四部分是通過對網(wǎng)絡(luò)游戲的作品屬性分析后,提出網(wǎng)絡(luò)游戲著作權(quán)立法建議以及如何保護(hù);最后一部分對全文進(jìn)行了總結(jié)。對于網(wǎng)絡(luò)游戲的作品屬性,總結(jié)如下:在遇到涉及整體侵犯網(wǎng)絡(luò)游戲著作權(quán)的情況下,網(wǎng)絡(luò)游戲可以作為一個(gè)整體被給予著作權(quán)法的保護(hù),而在涉及到網(wǎng)絡(luò)游戲的要素侵權(quán)時(shí),這些要素也可以作為著作權(quán)法意義上的作品,給予單獨(dú)的保護(hù)。因此建議將網(wǎng)絡(luò)游戲納入著作權(quán)法的作品范圍之中。
[Abstract]:In the judgment of copyright infringement cases of online games in our country, because of the complexity of the cases, it is a difficult problem to determine the property of the works of online games. However, when the composing elements of online games are copied or other copyright infringement problems are encountered, how to identify the properties of these elements needs to be solved urgently in reality. By classifying the online games, this paper analyzes the abstractness of the components of different types of online games from the point of view of the design and development of the online games, and then sums up and summarizes these elements. This paper summarizes the possible general elements of online games, and then makes a theoretical study of whether these general elements belong to thought or expression, sums up the elements that belong to expression, and expounds the originality of these elements of expression. The thesis is divided into five parts: firstly, it introduces two typical cases in judicial practice; the second part summarizes the status quo and types of infringement of online game copyright. The third part is the main part of the paper. After analyzing the classification of online games, it explores and abstracts the elements of different categories. This paper summarizes the general elements of online games, and then combines these elements with the basic theory of copyright law, sums up the elements that belong to the expression, and studies the originality of the standards. The fourth part is through the analysis of the properties of the works of online games, put forward the legislative recommendations and how to protect the copyright of online games; the last part of the full text is summarized. The characteristics of online games are summarized as follows: when it comes to the whole infringement of the copyright of online games, the online games can be protected by copyright law as a whole, and when the elements of online games are infringed, These elements may also be protected separately as works in the sense of copyright law. Therefore, it is suggested to bring online games into the scope of copyright law.
