【摘要】：隨著網(wǎng)絡技術(shù)的迅速發(fā)展,我國著作權(quán)侵權(quán)問題日益嚴重呈現(xiàn)侵權(quán)范圍更廣、規(guī)模更大、數(shù)量更多、侵權(quán)危害更深等特點,本文列舉近年來網(wǎng)絡著作侵權(quán)的典型案例,對比分析出網(wǎng)絡著作侵權(quán)產(chǎn)生的原因主要有互聯(lián)網(wǎng)自身特性、著作權(quán)歸屬不清、法律制度不夠完善、技術(shù)有待更新等方面,并在此基礎上探討了網(wǎng)絡著作侵權(quán)對傳播過程中的著作權(quán)利人、信息、受眾、法律制度和文化創(chuàng)新及產(chǎn)業(yè)的影響,最后從法律制度建設、著作權(quán)開發(fā)、著作權(quán)管理及著作權(quán)技術(shù)等方面提出侵權(quán)問題解決的辦法和建議。
[Abstract]:With the rapid development of network technology, the problem of copyright infringement in our country is becoming more serious, with the characteristics of wider scope, larger scale, more quantity and deeper harm of infringement, etc. This paper enumerates the typical cases of infringement of network works in recent years. The main reasons for the infringement of network works are the characteristics of the Internet itself, the unclear ownership of copyright, the imperfect legal system, the technology to be updated and so on. On this basis, this paper discusses the influence of the infringement of network works on the right holders, information, audience, legal system, cultural innovation and industry in the process of dissemination, finally, from the legal system construction, copyright development, Copyright management and copyright technology and other aspects of the solution to the problem of infringement and suggestions.
