【摘要】：隨著網絡技術的飛速發(fā)展,互聯(lián)網這個新科技工具開始走近人們的工作、學習和生活。網絡技術給人們生活帶來便利的同時,也極大地沖擊了現有的著作權保護體系,由此在審判實踐中產生了許多新的問題。網絡海量信息共享并可低成本復制的特點使得侵犯網絡著作權的行為普遍,嚴重侵害了著作權人的利益,這使得對網絡空間的權利保護已經迫在眉睫。 本文將從網絡著作權方面對網絡空間里存在的侵權問題進行初步探析。本文整體分為四個部分,第一部分主要闡述網絡著作權的基礎理論,包括著作權和網絡著作權的定義和特征；第二部分主要闡述網絡著作權的侵權行為,包括侵權行為及其特點；第三部分主要闡述網絡著作權的損害賠償原則；第四部分主要闡述對于處理網絡著作權侵權案件的若干建議,包括完善現有的網絡著作權法律制度、統(tǒng)一審判中的執(zhí)法尺度及完善證據保全制度。
[Abstract]:With the rapid development of network technology, the Internet, a new technological tool, is beginning to approach people's work, study and life.While the network technology brings convenience to people's life, it also greatly impacts the existing copyright protection system, which brings about many new problems in the trial practice.The characteristics of network mass information sharing and low cost reproduction make the infringement of network copyright widespread and seriously encroach on the interests of copyright owners. This makes the protection of rights in cyberspace imminent.This article will analyze the infringement problem in cyberspace from the aspect of network copyright.This paper is divided into four parts as a whole. The first part mainly expounds the basic theory of network copyright, including the definition and characteristics of copyright and network copyright, the second part mainly expounds the infringement of network copyright.Including tort and its characteristics; the third part mainly expounds the principle of network copyright damage compensation; the fourth part mainly expounds some suggestions for dealing with network copyright infringement cases, including improving the existing legal system of network copyright.Unify the law enforcement standard in the trial and perfect the evidence preservation system.
