【摘要】：[目的 /意義]研究ODC協(xié)議對(duì)處理開放數(shù)據(jù)著作問題、降低數(shù)據(jù)利用侵權(quán)風(fēng)險(xiǎn)、預(yù)防數(shù)據(jù)權(quán)益糾紛發(fā)生、實(shí)現(xiàn)開放數(shù)據(jù)可持續(xù)發(fā)展具有重要意義。[方法 /過程]以法律關(guān)系分析方法,厘清覆蓋于數(shù)據(jù)之上的著作權(quán)法律關(guān)系;以字面解釋等法律解釋方法,對(duì)ODC協(xié)議及其重要條款進(jìn)行解讀;以案例調(diào)研、比較研究等方法,對(duì)ODC協(xié)議的適用問題進(jìn)行歸納并提出解決方案。[結(jié)果 /結(jié)論]ODC協(xié)議通過將數(shù)據(jù)的著作權(quán)法律關(guān)系解構(gòu)為單個(gè)數(shù)據(jù)、數(shù)據(jù)內(nèi)容、數(shù)據(jù)庫、衍生數(shù)據(jù)庫、集成數(shù)據(jù)庫、數(shù)據(jù)產(chǎn)出等部分來設(shè)計(jì)授權(quán)使用條款,將開放數(shù)據(jù)的使用者擴(kuò)展至所有主體,技巧性地回避了對(duì)事實(shí)數(shù)據(jù)進(jìn)行授權(quán)的法理難題,同時(shí)從多個(gè)方面實(shí)現(xiàn)了協(xié)議的明確性、全球性和前瞻性。ODC協(xié)議是開放數(shù)據(jù)著作權(quán)問題的有效解決方案之一,適用時(shí)建議同時(shí)建立數(shù)據(jù)許可權(quán)限管理機(jī)制、科學(xué)發(fā)現(xiàn)權(quán)的承認(rèn)與保護(hù)機(jī)制,并建議在未來的ODC協(xié)議更新版本中完善對(duì)被許可人惡意重復(fù)違約的規(guī)制問題。
[Abstract]:[objective / significance] to study the effect of ODC protocol on dealing with the problem of open data works, reducing the risk of infringement of data utilization, and preventing the occurrence of disputes over data rights and interests. The realization of sustainable development of open data is of great significance. [methods / processes] clarify the copyright legal relationships that cover the data by means of legal relationship analysis; legal interpretation methods such as literal interpretation, To interpret the ODC agreement and its important provisions, to investigate cases, to compare the methods, The application of ODC protocol is summarized and the solution is put forward. [result / conclusion] the ODC protocol deconstructs the copyright legal relationship of data into a single data, data content, database, derivative database, integrated database. Data output and other parts to design the terms of authorization, expand the users of open data to all subjects, skillfully avoid the legal problem of authorizing the factual data, at the same time, realize the clarity of the agreement from many aspects. The global and forward-looking .ODC protocol is one of the effective solutions to open the issue of data copyright. Where applicable, it is recommended that a mechanism for the management of data permission rights and the recognition and protection of the right to scientific discovery be established at the same time, It is suggested to improve the regulation of malicious repeated breach of the licensee in the future updated version of the ODC protocol.
