【摘要】：數(shù)字時代的到來，引發(fā)了技術(shù)進步與法律滯后、數(shù)字出版與傳統(tǒng)出版、互聯(lián)網(wǎng)自由傳播與作家利益保護等沖突，對著作權(quán)法提出了嚴(yán)峻的挑戰(zhàn)。隨著越來越多的大眾參與到網(wǎng)絡(luò)中創(chuàng)造內(nèi)容，表達自己的想法、觀點、意見，UGC網(wǎng)絡(luò)環(huán)境下的侵權(quán)現(xiàn)象成為社會各界廣泛關(guān)注的社會問題。各種UGC侵權(quán)訴訟已成為互聯(lián)網(wǎng)行業(yè)發(fā)展不得不面對的問題。在UGC網(wǎng)絡(luò)環(huán)境下的網(wǎng)絡(luò)版權(quán)侵權(quán)行為涉及到對內(nèi)容創(chuàng)造用戶、UGC平臺提供者、著作權(quán)主體等多方利益的平衡問題，因此有必要對我國網(wǎng)絡(luò)版權(quán)保護立法進行完善，以平衡和保護各方利益，，創(chuàng)造更大的社會價值。本文第一部分對UGC及網(wǎng)絡(luò)版權(quán)的相關(guān)內(nèi)容進行了概述；第二部分以“百度文庫侵權(quán)門”為切入點，由此引出對UGC網(wǎng)絡(luò)環(huán)境下版權(quán)保護困惑的分析，并對其保護的必要性進行價值論證；第三部分對UGC網(wǎng)絡(luò)環(huán)境下版權(quán)侵權(quán)行為的具體表現(xiàn)、主體、構(gòu)成要件、歸責(zé)原則和責(zé)任類型等基本理論進行了詳細(xì)分析；第四部分則列舉了發(fā)達國家和地區(qū)關(guān)于UGC侵權(quán)的治理模式，在分析并借鑒其有益經(jīng)驗的基礎(chǔ)上，對我國UGC環(huán)境下網(wǎng)絡(luò)版權(quán)保護立法提出完善構(gòu)想。
[Abstract]:The advent of the digital age has caused conflicts between technological progress and legal lag, between digital publishing and traditional publishing, between the free spread of the Internet and the protection of writers' interests, etc. As more and more people participate in creating content, expressing their ideas and opinions in the Internet, All kinds of UGC tort litigation has become a problem that the development of the Internet industry must face. In the UGC network environment, the copyright infringement on the network has become a problem. To create a user UGC platform provider for content creation, Therefore, it is necessary to perfect the legislation of network copyright protection in our country in order to balance and protect the interests of all parties. The first part of this paper summarizes the related content of UGC and network copyright, the second part takes "Baidu library infringement door" as the breakthrough point, which leads to the analysis of the confusion of copyright protection under the UGC network environment. The third part of the UGC network environment of copyright infringement specific performance, subject, elements, liability principles and types of basic theory are analyzed in detail; Part 4th lists the governance models of UGC infringement in developed countries and regions. On the basis of analyzing and drawing lessons from its beneficial experience, the author puts forward a perfect conception on the legislation of network copyright protection under the environment of UGC in our country.
