【摘要】：互聯(lián)網(wǎng)為我們提供了豐富的資源，信息傳播為社會帶來了極大的便利。網(wǎng)頁作為互聯(lián)網(wǎng)的門面，具有經(jīng)濟利益和權利價值，人們在瀏覽網(wǎng)頁的過程中可以迅速的獲取信息，但網(wǎng)頁相關著作權卻常常被忽略。抄襲和仿冒的行為屢屢出現(xiàn)，接踵而至的便是一系列的網(wǎng)頁相關著作權案例。這些引起了社會的廣泛關注，對于網(wǎng)頁的法律認定具有非常重要的意義。 本文以網(wǎng)頁的三個構成要素為框架，每個構成要素為線索結合案例進行分析。在網(wǎng)星訴英網(wǎng)公司案中，主要討論了網(wǎng)頁源程序著作權和網(wǎng)頁版面設計著作權。在創(chuàng)聯(lián)訴匯盟公司案中，主要討論了網(wǎng)頁是否構成公有領域匯編作品著作權保護。在“榕樹下”網(wǎng)站訴中國社會出版社案中，主要討論了網(wǎng)上數(shù)字化作品是否受法律保護。 最后，歸納總結出了司法實踐中對網(wǎng)頁性質(zhì)的認定和自己對網(wǎng)頁保護的幾點認識，網(wǎng)頁的出現(xiàn)，，實質(zhì)上是對作品傳統(tǒng)分類的一個沖擊，隨著科學技術的不斷進步和發(fā)展，可能還會出現(xiàn)新的作品類型。通過上述案例的探析，為應對不斷出現(xiàn)的新的作品形式提供參考。
[Abstract]:The Internet provides us with abundant resources, and the dissemination of information brings great convenience to the society. As the facade of the Internet, web pages have economic interests and rights value, people can quickly obtain information in the process of browsing the web pages. But web-related copyright is often ignored. Plagiarism and counterfeiting occur frequently, followed by a series of web-related copyright cases. The legal recognition of web pages is of great significance. This article takes the three constituent elements of the web page as the frame, each element as the clue to carry on the analysis with the case. This paper mainly discusses the copyright of web page source program and the copyright of page layout design. This paper mainly discusses whether the web page constitutes the copyright protection of the compilation works in the public domain. In the case of "banyan Tree" website v. China Social Publishing House, it mainly discusses whether the digital works on the Internet are protected by law. Finally, the author summarizes the recognition of the nature of the web page in judicial practice and his own understanding of the protection of the page. The appearance of the web page is, in essence, an impact on the traditional classification of works, and with the continuous progress and development of science and technology, New types of works may also appear. Through the analysis of the above cases, this paper provides a reference for dealing with the emerging new forms of works.
