【摘要】：隨著數(shù)字傳播技術(shù)的飛速發(fā)展，借助網(wǎng)絡(luò)進(jìn)行的廣播已經(jīng)成為向公眾傳播作品的新方式，網(wǎng)絡(luò)廣播組織正扮演著在數(shù)字內(nèi)容服務(wù)方面越來越重要的角色。網(wǎng)播產(chǎn)業(yè)作為新媒體產(chǎn)業(yè)的代表之一，，在世界范圍內(nèi)迅速發(fā)展。網(wǎng)絡(luò)廣播的形式包括即時(shí)網(wǎng)絡(luò)同步轉(zhuǎn)播他人的廣播節(jié)目、網(wǎng)播組織自己制作內(nèi)容向公眾定時(shí)播出以及將節(jié)目?jī)?nèi)容放到網(wǎng)上供公眾自由選擇等；傳播方式包括交互式和非交互式；平臺(tái)也早已不局限于計(jì)算機(jī)互聯(lián)網(wǎng)，與移動(dòng)電信網(wǎng)絡(luò)和有線電視網(wǎng)互相融合向消費(fèi)者提供綜合多媒體通信業(yè)務(wù)是大勢(shì)所趨；這些都對(duì)現(xiàn)行的著作權(quán)制度提出了新的挑戰(zhàn)。本文系統(tǒng)、全面地審視和探討了廣義網(wǎng)絡(luò)廣播行為的性質(zhì)、特點(diǎn)，根據(jù)不同傳播手段對(duì)其分類。并逐類指出其對(duì)傳統(tǒng)著作權(quán)制度提出的挑戰(zhàn)，再分析國(guó)際社會(huì)和其他國(guó)家為應(yīng)對(duì)挑戰(zhàn)所提出的解決方案，以期為我國(guó)現(xiàn)行相關(guān)立法和制度的完善梳理思路。本文分為四個(gè)部分： 第一部分主要概述了網(wǎng)絡(luò)廣播的誕生和發(fā)展歷程，闡述了目前存在的各種形式的網(wǎng)絡(luò)廣播，并根據(jù)傳播手段的不同對(duì)其進(jìn)行分類，指出網(wǎng)絡(luò)廣播與傳統(tǒng)廣播媒體相比的突出特點(diǎn)。 第二部分?jǐn)⑹隽司W(wǎng)絡(luò)廣播對(duì)傳統(tǒng)著作權(quán)立法提出的挑戰(zhàn)，一是傳統(tǒng)的廣播權(quán)由于受到法律制定時(shí)技術(shù)條件的限制，無法規(guī)制廣義的網(wǎng)絡(luò)廣播，通過廣義網(wǎng)絡(luò)廣播傳播作品的行為無法受到作品權(quán)利人的控制；二是廣播組織權(quán)方面，廣播組織享有的傳統(tǒng)轉(zhuǎn)播權(quán)也無法規(guī)制網(wǎng)絡(luò)同步轉(zhuǎn)播行為；三是新興的狹義網(wǎng)絡(luò)廣播組織是否應(yīng)納入廣播組織的范圍而使其享有廣播組織權(quán)的問題。 第三部分首先敘述了《世界知識(shí)產(chǎn)權(quán)組織版權(quán)條約》為應(yīng)對(duì)數(shù)字環(huán)境而制定的第8條的內(nèi)容，該條規(guī)定著作權(quán)人享有授權(quán)將其作品以有線或無線方式向公眾傳播的權(quán)利，那么廣義的網(wǎng)絡(luò)廣播都可以落入其控制范圍，世界其他各國(guó)也都采取了不同的立法模式達(dá)到了該條的保護(hù)標(biāo)準(zhǔn)。其次研究了《世界知識(shí)產(chǎn)權(quán)組織廣播條約（草案）》試圖對(duì)廣播組織權(quán)的主體、客體和權(quán)利內(nèi)容做出的新規(guī)定，尤其是有關(guān)“網(wǎng)絡(luò)廣播”和“網(wǎng)播組織”的定義。但由于世界各國(guó)之間的利益博弈，對(duì)該草案一直存在巨大的爭(zhēng)議，遲遲未獲通過。 第四部分重點(diǎn)關(guān)注我國(guó)《著作權(quán)法》的相關(guān)規(guī)定。我國(guó)《著作權(quán)法》對(duì)“廣播權(quán)”和“信息網(wǎng)絡(luò)傳播權(quán)”的規(guī)定都存在著不足，使得有線廣播和非交互式的網(wǎng)絡(luò)廣播都無法受到著作權(quán)人的控制，未達(dá)到WCT第8條的標(biāo)準(zhǔn)。2012年3月新公布的《〈著作權(quán)法〉修改草案》針對(duì)這個(gè)問題做出了修改，但在立法模式、具體術(shù)語和措辭等方面還有可商榷之處。筆者提出了自己的建議。 此次修訂《著作權(quán)法》，必須首先達(dá)到WCT的保護(hù)標(biāo)準(zhǔn)，將各種以有線或無線方式向公眾傳播作品的行為都納入著作權(quán)人的控制范圍。而在廣播組織權(quán)的規(guī)定方面，則要綜合考慮我國(guó)的公共政策、信息產(chǎn)業(yè)未來發(fā)展以及三網(wǎng)融合的進(jìn)程等各方面因素，以審慎的態(tài)度參與國(guó)際社會(huì)有關(guān)此問題的討論，并制定出符合我國(guó)國(guó)情，能適應(yīng)未來技術(shù)發(fā)展的需要和國(guó)際趨勢(shì)，而又兼顧利益平衡的制度。
[Abstract]:With the rapid development of the digital broadcasting technology , the broadcasting of the network has become a new way to disseminate the works to the public . The network broadcasting organization is playing a more and more important role in digital content services . The first part mainly summarizes the birth and development course of the network broadcast , expounds the existing forms of network broadcast , classifies them according to the different propagation means , and points out the prominent characteristics of the network broadcast as compared with the traditional broadcast media . The second part describes the challenge of network broadcasting to the traditional copyright legislation , one is that the traditional broadcasting right is limited by the technical conditions when the law is established , and the act of broadcasting the works by the broad network is not controlled by the author ' s right person ; secondly , the broadcasting organization enjoys the traditional broadcasting right without the regulation network synchronous broadcasting behavior ; and thirdly , whether the emerging narrow network broadcasting organization should be included in the scope of the broadcasting organization so as to enable the broadcasting organization to enjoy the right of broadcasting organization . The third part firstly describes the content of Article 8 , which is formulated by the copyright treaty of the WIPO World Intellectual Property Organization to deal with the digital environment , which stipulates that the copyright owner has the right to authorize the dissemination of his work in a wired or wireless manner to the public . The fourth part focuses on the relevant regulations of copyright law in China . The stipulation of copyright law of copyright in China is insufficient , so that both wired and non - interactive network broadcasts can ' t be controlled by the copyright owner . The revision of copyright law should firstly meet the protection standard of WCT , and include all kinds of behaviors which can be transmitted to the public in a wired or wireless way into the control range of the copyright owner . In the aspect of the right of broadcasting organization , we should take a careful attitude to the discussion of the international community about the issue and formulate the system which is in accordance with our national conditions and can meet the needs and international trend of the future technology development , but also the balance of interest .
