【摘要】：著作權(quán)侵權(quán)損害賠償是我國著作權(quán)制度構(gòu)建中的重要問題之一,其適用原則理論上一致存在補償性和懲罰性之爭,我國著作權(quán)侵權(quán)損害賠償采用的是補償性賠償,但在著作權(quán)日漸重要,侵權(quán)行為日趨猖獗的情況下,應(yīng)當(dāng)適當(dāng)適用懲罰性賠償。雖然我國理論界一直不承認懲罰性賠償在民法領(lǐng)域的適用,但是無論從懲罰性賠償?shù)漠a(chǎn)生還是現(xiàn)代侵權(quán)法的發(fā)展,甚至從社會實質(zhì)公平正義角度來看,懲罰性賠償都有其存在的學(xué)理基礎(chǔ),著作權(quán)侵權(quán)的特殊性更為其在著作權(quán)侵權(quán)領(lǐng)域的適用奠定了結(jié)實的制度根基。雖然著作權(quán)侵權(quán)懲罰性賠償至今沒有一個明確的概念,但是作為著作權(quán)侵權(quán)損害賠償?shù)囊环N原則,可以從著作權(quán)侵權(quán)損害賠償出發(fā),結(jié)合懲罰性賠償?shù)母拍顏韺χ鳈?quán)侵權(quán)懲罰性賠償進行界定。懲罰性賠償與補償性賠償最大的不同在于目的,前者重在懲罰,附帶補償；后者主要補償,附帶一定的懲罰功能。在當(dāng)今知識經(jīng)濟時代,我國著作權(quán)侵權(quán)損害賠償?shù)默F(xiàn)狀要求在著作權(quán)侵權(quán)損害賠償中引入懲罰性賠償,不僅僅因為補償性賠償在著作權(quán)人救濟方面的不足,更因為通過比較分析著作權(quán)侵權(quán)補償性賠償和懲罰性賠償?shù)慕?jīng)濟效益,著作權(quán)侵權(quán)懲罰性賠償更能起到遏制和預(yù)防的作用。在可行性方面,我國現(xiàn)行法律體系中已有的懲罰性賠償適用的先例,如《消費者權(quán)益保護法》,且在現(xiàn)行的著作權(quán)侵權(quán)損害賠償中也有懲罰性賠償?shù)囊蛩?為正式全面的在著作權(quán)侵權(quán)領(lǐng)域適用懲罰性賠償打下了很好的基礎(chǔ)。而且從國際范圍來看,在著作權(quán)侵權(quán)領(lǐng)域適用懲罰性賠償有很好的國際環(huán)境。同時,著作權(quán)侵權(quán)懲罰性賠償在我國的適用,既要借鑒國外的立法經(jīng)驗,更重要的是要結(jié)合我國的具體情況,來確定具體的適用范圍、適用條件和懲罰性賠償金。
[Abstract]:The compensation for copyright infringement is one of the most important problems in the construction of copyright system in China. The compensation for copyright infringement in our country is compensatory compensation, but in the case of the increasing importance of copyright and rampant infringement. Punitive damages should be properly applied. Although the application of punitive damages in the field of civil law has not been recognized by the theoretical circle of our country, whether from the emergence of punitive damages or the development of modern tort law. Even from the perspective of social justice, punitive damages have their theoretical basis. The particularity of copyright infringement lays a solid institutional foundation for its application in the field of copyright infringement, although there is no clear concept of punitive damages for copyright infringement. However, as a principle of compensation for copyright infringement damage, we can proceed from copyright infringement compensation. Combined with the concept of punitive damages to define punitive damages for copyright infringement. The biggest difference between punitive damages and compensatory damages lies in the purpose, the former focuses on punishment, collateral compensation; In the era of knowledge economy, the current situation of copyright infringement damages in China requires the introduction of punitive damages in copyright infringement damages. Not only because of compensatory compensation in the relief of copyright owners, but also because of the comparative analysis of copyright infringement compensation and punitive damages of economic benefits. Punitive damages for copyright infringement can play a more role in containment and prevention. In terms of feasibility, there are precedents for the application of punitive damages in the current legal system of our country, such as the Consumer Rights and interests Protection Law. And in the current copyright infringement damages there are also punitive damages for the formal and comprehensive application of punitive damages in the field of copyright infringement lay a good foundation. And from the international perspective. The application of punitive damages in the field of copyright infringement has a good international environment. At the same time, the application of punitive damages of copyright infringement in China should draw lessons from foreign legislative experience. It is more important to determine the specific scope of application, applicable conditions and punitive damages according to the specific conditions of our country.
