【摘要】：本文從我國礦產(chǎn)資源產(chǎn)權(quán)制度的安排形式入手,分析了誰是礦產(chǎn)資源的實(shí)際所有者和礦產(chǎn)資源產(chǎn)權(quán)制度運(yùn)行的矛盾。分析結(jié)果表明,礦產(chǎn)資源實(shí)際是由地方政府所掌控。此外,采礦權(quán)人和土地所有者之間的沖突、各管理部門之間沒有統(tǒng)一的規(guī)劃協(xié)調(diào)是采礦權(quán)主體行使其采礦權(quán)的主要阻礙。進(jìn)而得出在當(dāng)前的礦產(chǎn)資源產(chǎn)權(quán)制度安排下,決定礦業(yè)開發(fā)主體以及開發(fā)過程中的利益分配是其主要的制度功能。最后,本文針對當(dāng)前產(chǎn)權(quán)制度運(yùn)行所產(chǎn)生的問題提出了相應(yīng)的解決措施。
[Abstract]:Starting with the arrangement of the property right system of mineral resources in China, this paper analyzes the contradiction between the actual owner of mineral resources and the operation of property rights system of mineral resources. The results show that mineral resources are actually controlled by local governments. In addition, the conflict between the mining owner and the land owner and the lack of unified planning coordination among the various management departments are the main obstacles for the main body of mining rights to exercise their mining rights. It is concluded that the main institutional function of mineral resources is to determine the main body of mining development and the distribution of benefits in the process of exploitation under the present arrangement of mineral resources property rights system. Finally, this paper puts forward the corresponding solutions to the problems arising from the operation of the current property right system.
