【摘要】:農(nóng)民工欠薪問(wèn)題在很長(zhǎng)一段時(shí)間以來(lái)一直是我國(guó)嚴(yán)重的社會(huì)問(wèn)題,尤其突出的表現(xiàn)在建筑領(lǐng)域。2003年的“總理討薪”事件,掀開(kāi)了全國(guó)各地整治和清欠農(nóng)民工工資行動(dòng)的大幕,此后的幾年,各地關(guān)于清欠成果的報(bào)道常見(jiàn)諸于媒體,欠薪問(wèn)題一度得到有效遏制。然而,隨著我國(guó)城市化進(jìn)程的不斷加快,建筑領(lǐng)域農(nóng)民工欠薪問(wèn)題仍然發(fā)生著并在每年的年終歲末持續(xù)如火如荼上演各種討薪事件,繼續(xù)沖擊著當(dāng)前勞動(dòng)關(guān)系的和諧及社會(huì)的安定穩(wěn)定。本文試圖通過(guò)以晉江市建筑領(lǐng)域農(nóng)民工欠薪問(wèn)題為研究對(duì)象,著重從政府行為進(jìn)行深入分析,闡明建筑領(lǐng)域農(nóng)民工欠薪現(xiàn)狀,點(diǎn)出問(wèn)題的根源,以及在治理這一問(wèn)題上的法律難題、行業(yè)背景、路徑依賴和現(xiàn)實(shí)困境,尤其是聯(lián)系晉江的實(shí)際,從具體政府行為的優(yōu)化角度去探尋更適宜、更有效的政府治理對(duì)策。建筑領(lǐng)域欠薪是個(gè)老話題,也是熱點(diǎn)問(wèn)題,僅國(guó)內(nèi)學(xué)術(shù)界對(duì)此問(wèn)題的研究就已較為深入,在此基礎(chǔ)上,本文嘗試以政府行為作為研究的內(nèi)容和視角,界定農(nóng)民工欠薪和政府行為的概念,以政府治理、新公共服務(wù)作為理論支撐,引入政府參與解決建筑領(lǐng)域欠薪的必要性和可行性,結(jié)合晉江市治理的現(xiàn)狀深入分析和實(shí)證研究,通過(guò)相關(guān)利益主體和政府部門的心理博弈分析,發(fā)現(xiàn)當(dāng)前做法存在的缺陷和影響因素,借鑒國(guó)內(nèi)其他城市的有效經(jīng)驗(yàn),嘗試提出針對(duì)晉江市實(shí)際行之有效的優(yōu)化建議,期望隨著政府治理的完善和其他方面的共同努力,建筑領(lǐng)域欠薪這一頑疾能夠得到有效的遏止。
[Abstract]:The problem of migrant workers' unpaid wages has been a serious social problem in China for a long time, especially in the field of construction. The 2003 incident of "asking for wages by the Prime Minister" has opened a big curtain for the rectification and action to clear up the wages of migrant workers throughout the country.In the years that followed, local reports of outstanding results were frequently reported in the media, and the issue of unpaid wages was effectively curbed.However, with the rapid development of urbanization in China, the problem of migrant workers' unpaid wages in the construction field still occurs and continues to play out in full swing at the end of each year's end of the year.Continue to impact on the current harmonious labor relations and social stability and stability.This paper attempts to take the problem of migrant workers in the construction field of Jinjiang as the research object, focusing on the in-depth analysis of the government behavior, to clarify the current situation of migrant workers in the construction field, and to point out the root of the problem.And the legal problems, industry background, path dependence and practical difficulties in governance, especially in connection with the reality of Jinjiang, from the point of view of the optimization of specific government behavior to explore more appropriate, more effective government governance countermeasures.Unpaid wages in the field of construction is an old topic, but also a hot issue, only the domestic academic research on this issue has been more in-depth, on the basis of this, this paper tries to take government behavior as the research content and perspective.Defining the concepts of migrant workers' unpaid wages and government behavior, taking government governance and new public services as theoretical support, introducing the necessity and feasibility of government participation in solving the problem of unpaid wages in the construction field, and combining the current situation of governance in Jinjiang City with an in-depth analysis and empirical research.Through the psychological game analysis of relevant stakeholders and government departments, this paper finds out the defects and influencing factors existing in the current practice, draws lessons from the effective experience of other cities in China, and tries to put forward some practical and effective optimization suggestions for Jinjiang City.It is hoped that with the improvement of government governance and the joint efforts of other parties, the persistent problem of unpaid wages in the construction field will be effectively curbed.
