【摘要】：睡虎地秦簡(jiǎn)內(nèi)容中雜糅了楚文化的因素,而整部秦簡(jiǎn)中對(duì)婚嫁的記載內(nèi)容占絕大多數(shù)。本論題以睡虎地秦簡(jiǎn)中與婚嫁有關(guān)的簡(jiǎn)文為主,綜合傳世文獻(xiàn)記載以及其它民俗材料,并在前人研究的基礎(chǔ)上,探討當(dāng)時(shí)背景下中下層民眾的婚姻習(xí)俗以及觀念。 首先,對(duì)《日書(shū)》所體現(xiàn)出的婚嫁禮俗進(jìn)行總的考察,包括婚嫁擇日禁忌、婚嫁禮儀;其次,就秦簡(jiǎn)體現(xiàn)出的婚姻觀念作較深入的探討,包括世俗對(duì)婚姻中丈夫與妻子的思想觀念,婦女在社會(huì)家庭中的地位與作用,休妻、再婚制度;第三,討論整個(gè)秦簡(jiǎn)所反映出的婚姻居室形態(tài),涉及秦代小家族家庭制度下的婚姻居住形態(tài)和居室結(jié)構(gòu)問(wèn)題。 通過(guò)以上論述,本文認(rèn)為:戰(zhàn)國(guó)晚期,秦楚社會(huì)中下層百姓的婚嫁以日者的占卜為擇日依據(jù),主要通過(guò)干支歷法、建除、星宿來(lái)?yè)窦芗?并以傳說(shuō)故事中不吉利的日子為忌日,婚嫁在禮俗上要進(jìn)行祭祀、飲宴、買(mǎi)賣(mài)奴隸、進(jìn)出財(cái)貨等活動(dòng);社會(huì)中下層百姓的婚姻觀念中,法律對(duì)男女分別有了一定約束,男子休妻要到官府登記,女子在社會(huì)、家庭生活地位仍然低下,并承擔(dān)了一定責(zé)任,在解除婚姻關(guān)系的問(wèn)題上,男子擁有最終決定權(quán),而女子始終處于服從的地位;秦楚實(shí)行的是小家族家庭制度,雖然擴(kuò)大家庭依然存在,但是,核心家庭已成為家庭模式的主流及發(fā)展趨勢(shì)。本文的結(jié)論對(duì)探討秦治理下的楚地社會(huì)習(xí)俗和婚姻觀念具有一定的作用。
[Abstract]:The content of Qin slips in Shuihudi mixed with the factors of Chu culture, and the whole Qin bamboo slips accounted for the vast majority of marriage records. This thesis mainly focuses on the short texts related to marriage in the Sleeping Tiger Land Qin slips, synthesizes the historical records and other folklore materials, and on the basis of the previous studies, probes into the marriage customs and concepts of the middle and lower classes of the people in the background at that time. First of all, the "Book of Marriage" reflected in the marriage ceremony and customs of a general investigation, including marriage taboo, marriage etiquette; Secondly, the marriage concept embodied in Qin Bamboo slips is discussed in depth, including the secular thoughts on husband and wife in marriage, the status and role of women in the social family, divorce and remarriage system. Third, the article discusses the marriage room form reflected by the whole Qin bamboo slips, which involves the marriage and residence form and the living room structure under the small family system in Qin Dynasty. Through the above discussion, this paper holds that: in the late warring States period, the marriage of the people of the lower classes of Qin and Chu dynasties took the divination of the Japanese as the basis for choosing the day, mainly through the Qianzhi calendar, the establishment of the calendar, the selection of the stars and the selection of good fortune to avoid the bogey. And in the legend of the unlucky day as the death day, marriage in the ceremony and custom to carry out sacrifice, drink banquet, buy and sell slaves, in and out of the goods and other activities; In the marriage concept of the middle and lower classes of people, the law has certain restrictions on men and women respectively. Men who repudiate their wives have to register with the government, and women still have a low status in society and family life, and have assumed certain responsibilities in the issue of dissolution of marriage relations. Men have the final say, while women are always in the position of obedience; Although the extended family still exists, the nuclear family has become the mainstream and development trend of the family model. The conclusion of this paper has certain function to discuss the social custom and marriage concept of Chu area under Qin government.
