【摘要】：瑤族刑事習(xí)慣法對(duì)于解決糾紛、維護(hù)社會(huì)秩序穩(wěn)定起著很大的作用。但也應(yīng)該看到傳統(tǒng)瑤族刑事習(xí)慣法中某些觀念與中國(guó)當(dāng)前刑事制定法理論與實(shí)踐存在部分脫節(jié)和沖突。建議因勢(shì)利導(dǎo),合理?yè)P(yáng)棄,通過(guò)改造與合理利用瑤族刑事習(xí)慣法中的積極因素,彌補(bǔ)國(guó)家刑事制定法的不足,同時(shí)應(yīng)該強(qiáng)化國(guó)家刑事司法效用,摒棄瑤族刑事習(xí)慣法落后糟粕之處,使之與刑事制定法互相對(duì)接,相互融合。
[Abstract]:Yao criminal customary law plays a great role in resolving disputes and maintaining social order and stability. But it should also be seen that some concepts in the traditional criminal customary law of Yao nationality are out of touch and conflict with the theory and practice of the current criminal law in China. It is suggested that we should make up for the deficiency of the national criminal law by reforming and reasonably utilizing the positive factors in the criminal customary law of the Yao nationality, and at the same time, we should strengthen the effectiveness of the state criminal justice. Abandoning the backward dross of Yao's criminal customary law, making it intertwine with the criminal law and merge with each other.
