【摘要】：專(zhuān)門(mén)用于搜索音頻文件的搜索引擎具有"實(shí)質(zhì)性非侵權(quán)用途",因此不能僅因?yàn)橐纛l搜索引擎目前被多數(shù)用戶(hù)用于搜索侵權(quán)歌曲,而認(rèn)定服務(wù)提供者具有主觀過(guò)錯(cuò)。如果權(quán)利人向搜索引擎服務(wù)提供者發(fā)出的通知中不含有能夠合理定位侵權(quán)內(nèi)容的信息,則不能認(rèn)為服務(wù)提供者"應(yīng)知"侵權(quán)內(nèi)容而要求其斷開(kāi)所有相關(guān)鏈接。在服務(wù)提供者并未宣傳音頻搜索引擎侵權(quán)用途的情況下,不能僅以服務(wù)提供者沒(méi)有使用過(guò)濾機(jī)制,以及其獲得了經(jīng)濟(jì)利益,而認(rèn)定其構(gòu)成引誘侵權(quán)。
[Abstract]:The search engine specially used to search audio files has a "material non-infringing purpose", so it cannot be assumed that the service provider has subjective fault just because the audio search engine is currently used by most users to search for infringing songs. If the notice sent by the obligee to the search engine service provider does not contain information that can reasonably locate the infringing content, then the service provider should not be "aware" of the infringing content and be required to disconnect all relevant links. If the service provider does not propagandize the infringing use of the audio search engine, the service provider should not be regarded as an inducer of infringement on the grounds that the service provider does not use the filtering mechanism and that the service provider has obtained economic benefits.
