【摘要】：網(wǎng)絡(luò)的出現(xiàn)帶給了這個(gè)世界巨大的驚喜，并被最大可能的運(yùn)用到人們的生產(chǎn)和生活當(dāng)中，但是伴隨著網(wǎng)絡(luò)發(fā)展而導(dǎo)致的涉網(wǎng)案件層出不窮，據(jù)統(tǒng)計(jì)，我國(guó)以網(wǎng)絡(luò)著作權(quán)為核心的糾紛案件呈逐年上升的趨勢(shì)，案件的形式內(nèi)容復(fù)雜多樣，包括網(wǎng)絡(luò)文字作品的非法使用與傳播，影視音樂作品在互聯(lián)網(wǎng)中的非法傳播，數(shù)字圖書館糾紛，不正當(dāng)?shù)乃阉饕骀溄拥鹊�，涉及多方利益鏈；審判結(jié)果會(huì)對(duì)網(wǎng)絡(luò)產(chǎn)業(yè)的發(fā)展有一定影響，引導(dǎo)網(wǎng)絡(luò)企業(yè)的發(fā)展戰(zhàn)略和經(jīng)營(yíng)方向，網(wǎng)絡(luò)的公開透明性也讓審判結(jié)果在社區(qū)中倍受討論，成為影響網(wǎng)民決斷的風(fēng)向標(biāo)。網(wǎng)絡(luò)技術(shù)發(fā)展迅速，因而涉網(wǎng)著作權(quán)案件包含的技術(shù)手段也在不斷更新，各種問題不斷涌現(xiàn)，且無所依，給審理帶來了諸多困難。在前數(shù)字時(shí)代，復(fù)制的有限性和傳輸?shù)母叱杀拘�，使得一般大眾不具有大眾傳播的能力，，因而�?duì)一些以公共利益為基礎(chǔ)的使用予以保護(hù)。在網(wǎng)絡(luò)時(shí)代，數(shù)字技術(shù)的飛速發(fā)展和電腦應(yīng)用的廣泛普及，以及網(wǎng)民數(shù)量的大量增加，數(shù)字傳輸變得簡(jiǎn)單易行，網(wǎng)絡(luò)用戶在具備電腦和網(wǎng)絡(luò)資源的情況下也可可是現(xiàn)實(shí)大范圍傳播。私人的復(fù)制、編輯和傳播很可能給作者帶了嚴(yán)重的經(jīng)濟(jì)損失，在這樣的情況下，正當(dāng)權(quán)利的保護(hù)便變得十分必要。法律保護(hù)是最強(qiáng)有力的武器，要加強(qiáng)立法，增強(qiáng)著作權(quán)的自我保護(hù)意識(shí)，加強(qiáng)技術(shù)措施的保護(hù)，積極改進(jìn)著作權(quán)授權(quán)機(jī)制，加強(qiáng)集體管理，創(chuàng)造和諧健康、有序發(fā)展的網(wǎng)絡(luò)著作權(quán)保護(hù)體系，從而促進(jìn)文化事業(yè)的發(fā)展，保護(hù)智力成果，構(gòu)建良性循環(huán)的出版發(fā)展。
[Abstract]:The emergence of the network brings the world a great surprise, and is most likely used in people's production and life, but with the development of the network resulting in an endless network cases, according to statistics, The dispute cases with the network copyright as the core in our country are on the rise year by year. The form of the cases is complicated and diverse, including the illegal use and dissemination of the network writing works, the illegal dissemination of the film and television music works on the Internet. Digital library disputes, improper search engine links, and so on, involve the multi-interest chain; the trial results will have a certain impact on the development of the network industry, guiding the development strategy and management direction of the network enterprises. The public transparency of the network also makes the trial results widely discussed in the community, and becomes the vane to influence the decision of Internet users. Because of the rapid development of network technology, the technical means included in the copyright cases involving the network are constantly updated, and various kinds of problems are constantly emerging, which brings a lot of difficulties to the trial. In the pre-digital era, the limitation of reproduction and the high cost of transmission make the general public not have the ability of mass communication, so that some use based on public interest is protected. In the era of network, with the rapid development of digital technology, the widespread popularization of computer applications and the large increase in the number of Internet users, digital transmission has become simple and easy. Network users in the case of computers and network resources can also be spread across a wide range of reality. Private reproduction, editing, and dissemination are likely to bring serious financial losses to the author, in which case the protection of legitimate rights becomes necessary. Legal protection is the most powerful weapon. It is necessary to strengthen legislation, strengthen the consciousness of self-protection of copyright, strengthen the protection of technical measures, actively improve the mechanism of copyright authorization, strengthen collective management, and create harmony and health. The orderly development of network copyright protection system will promote the development of cultural undertakings, protect intellectual achievements, and build a virtuous circle of publishing development.
