【摘要】：基礎(chǔ)設(shè)施和公用事業(yè)是城市發(fā)展的基礎(chǔ),目前我國城鎮(zhèn)化進程的快速推進加大了對基礎(chǔ)設(shè)施和公用事業(yè)的需求,單純的政府直接投資已難以滿足蓬勃發(fā)展的基礎(chǔ)設(shè)施和公用事業(yè)項目建設(shè)。BT模式作為一種新型的融資建設(shè)模式,將政府和企業(yè)的優(yōu)勢相結(jié)合,既有效地緩解了政府的財政壓力,使其能夠利用民間資本提前進行基礎(chǔ)設(shè)施和公用事業(yè)項目的建設(shè),促進城市的進一步發(fā)展,又為企業(yè)拓寬了投資渠道,改變了以往投資渠道單一的局面,使其能夠通過參與BT建設(shè)項目來獲得穩(wěn)定的收益,并且實現(xiàn)資本運營能力的提升和盈利模式的轉(zhuǎn)變。另外,在BT建設(shè)項目中,政府從過去集投融資人、建設(shè)者和管理者等多種身份于一身的情況轉(zhuǎn)變?yōu)楹暧^范圍的監(jiān)管者、服務(wù)者的角色,實現(xiàn)了政府職能的轉(zhuǎn)變。因此,BT模式具有廣闊的應(yīng)用前景。 BT建設(shè)項目主要為非經(jīng)營性的基礎(chǔ)設(shè)施和公用事業(yè)項目,其自身的公益性決定了政府監(jiān)管的必要性。政府監(jiān)管必須貫穿于BT建設(shè)項目的始終,在其決策、準(zhǔn)備、招標(biāo)、建設(shè)和移交的各個階段通過采取法律、行政、經(jīng)濟等一系列手段發(fā)揮作用,以使廣大公眾利益得到有效保障。 本文以BT建設(shè)項目政府監(jiān)管模式為研究主題。首先介紹了BT模式的涵義、特征及其運作機制,闡述了政府監(jiān)管的涵義、分類及其理論依據(jù),然后總結(jié)了現(xiàn)行BT建設(shè)項目的政府監(jiān)管模式,并指出其存在缺少法律支持、監(jiān)管機構(gòu)設(shè)置不合理、專業(yè)性不足、缺乏有效監(jiān)督等問題,最后在借鑒主要發(fā)達國家在相關(guān)領(lǐng)域政府監(jiān)管經(jīng)驗的基礎(chǔ)之上,提出完善BT建設(shè)項目政府監(jiān)管模式需遵循法制化、獨立性、合理性、效率性和約束性的原則,進而根據(jù)這些原則從BT建設(shè)項目政府監(jiān)管立法、監(jiān)管機構(gòu)設(shè)置、監(jiān)管機構(gòu)人員配置、約束機制以及監(jiān)管影響評價等方面對完善BT建設(shè)項目政府監(jiān)管模式進行了較為系統(tǒng)的分析。
[Abstract]:Infrastructure and public utilities are the foundation of urban development. At present, the rapid progress of urbanization in China has increased the demand for infrastructure and public utilities. Simple government direct investment has been difficult to meet the vigorous development of infrastructure and public utility project construction. BT model, as a new financing construction model, combines the advantages of the government and enterprises, which not only effectively alleviates the financial pressure of the government. It can make use of private capital to carry out the construction of infrastructure and public utilities projects in advance, promote the further development of the city, broaden the investment channels for enterprises, change the situation of single investment channels in the past, enable them to obtain stable income by participating in BT construction projects, and realize the improvement of capital operation ability and the transformation of profit model. In addition, in the BT construction project, the government has changed from a variety of identities, such as financiers, constructors and managers, to macro-scope regulators and the role of service providers, thus realizing the transformation of government functions. Therefore, BT model has a broad application prospect. BT construction projects are mainly non-operating infrastructure and public utilities projects, its own public welfare determines the necessity of government supervision. Government supervision must run through the BT construction project from beginning to end, in its decision-making, preparation, bidding, construction and transfer through a series of means, such as legal, administrative, economic and other means to effectively protect the interests of the general public. This paper takes the government supervision mode of BT construction project as the research topic. This paper first introduces the meaning, characteristics and operation mechanism of BT mode, expounds the meaning, classification and theoretical basis of government supervision, and then sums up the current government supervision mode of BT construction projects, and points out that there are some problems, such as lack of legal support, unreasonable establishment of regulatory institutions, lack of effective supervision, etc., and finally, on the basis of drawing lessons from the experience of major developed countries in government supervision in related fields, This paper puts forward that it is necessary to follow the principles of legalization, independence, rationality, efficiency and restriction in order to perfect the government supervision mode of BT construction project, and then makes a systematic analysis on perfecting the government supervision mode of BT construction project from the aspects of government supervision legislation, supervision agency setting, supervision agency staffing, restraint mechanism and supervision impact evaluation.
