【摘要】：在建設(shè)工程項(xiàng)目管理過(guò)程中,合同索賠是經(jīng)常發(fā)生的事情。合同索賠是工程合同當(dāng)事人保護(hù)自身利益的一種重要手段,是工程項(xiàng)目合同管理的核心內(nèi)容。由于索賠涉及到合同雙方的切身利益而受到發(fā)包人及承包商的高度重視,索賠管理工作的好壞是衡量-個(gè)企業(yè)合同管理水平的一項(xiàng)重要指標(biāo)。加強(qiáng)索賠管理,研究索賠方法,對(duì)規(guī)范合同管理,提高工程項(xiàng)目管理水平有著重要的現(xiàn)實(shí)意義。 本文對(duì)合同索賠的基本理論：索賠的概念、特征,索賠的分類(lèi)及索賠的工作程序,索賠爭(zhēng)端解決等內(nèi)容作了闡述,從承包商的角度通過(guò)對(duì)索賠小組的組建,索賠機(jī)會(huì)識(shí)別,索賠策略研究及索賠報(bào)告的編制等管理工作作了深入的研究,并對(duì)索賠預(yù)防及反索賠作了研究。最后結(jié)合工程索賠的實(shí)際案例,論述索賠管理的具體工作內(nèi)容。論文所研究的內(nèi)容,為承包商深刻理解合同索賠管理的工作要求及意義,加強(qiáng)日常索賠管理有一定的借鑒作用。
[Abstract]:In the construction project management process, the contract claim occurs frequently. Contract claim is an important means for the parties to protect their own interests and the core content of project contract management. Because the claim involves the vital interests of both parties to the contract, it is highly valued by the contractor and the contractor. The quality of claim management is an important index to measure the level of contract management in individual enterprises. It is of great practical significance to strengthen the claim management and study the claim method to standardize the contract management and improve the engineering project management level. This paper expounds the basic theory of contract claims: the concept, characteristics, classification of claims, working procedures of claims, dispute settlement of claims, and so on. From the point of view of the contractor, it identifies the claim opportunities through the formation of claim panels, the identification of claim opportunities, and so on. The management of claim strategy and claim report has been studied deeply, and the claim prevention and counterclaim have been studied. Finally, combined with the actual case of engineering claims, the specific work content of claim management is discussed. The contents of this paper can be used as a reference for the contractor to understand the requirements and significance of contract claim management and to strengthen the daily claim management.
