【摘要】：數(shù)字檔案資源云存儲(chǔ)服務(wù)是一個(gè)值得探討的熱點(diǎn)問(wèn)題。本文從法律合同的視角,通過(guò)簡(jiǎn)要介紹云存儲(chǔ)服務(wù)合同模式、云存儲(chǔ)服務(wù)合同所適用的法律和文件檔案管理標(biāo)準(zhǔn),系統(tǒng)地論述了檔案機(jī)構(gòu)使用云存儲(chǔ)服務(wù)管理數(shù)字檔案資源時(shí),應(yīng)在簽訂合同中關(guān)注的6個(gè)主要問(wèn)題:數(shù)據(jù)所有權(quán)和知識(shí)產(chǎn)權(quán)、數(shù)據(jù)利用、數(shù)據(jù)處置與跟蹤、數(shù)據(jù)憑證價(jià)值和安全、數(shù)據(jù)存放地點(diǎn)和跨境遷移和云存儲(chǔ)服務(wù)合同終止。這些問(wèn)題的分析有助于尋求檔案機(jī)構(gòu)和云存儲(chǔ)服務(wù)商之間的利益平衡點(diǎn),使云存儲(chǔ)服務(wù)更好服務(wù)于數(shù)字檔案資源的建設(shè)。
[Abstract]:The cloud storage service of digital file resource is a hot issue worth discussing. From the perspective of legal contract, this paper introduces briefly the mode of cloud storage service contract, the law and file management standard applicable to cloud storage service contract, and systematically discusses the use of cloud storage service in the management of digital archives resources by archives organizations. Six main issues to be addressed in the signing of contracts: data ownership and intellectual property rights, data utilization, data disposal and tracking, data voucher value and security, data storage location and cross-border migration, and cloud storage service contract termination. The analysis of these problems is helpful to seek the benefit balance point between archives organization and cloud storage service provider, and make cloud storage service better serve the construction of digital archives resource.
