基于多途徑的道路交通事故車速鑒定方法研究

【摘要】:隨著我國社會的快速發(fā)展,公路里程數(shù)的不斷增加,汽車保有量的不斷提升,道路交通事故總量高居不下。道路交通安全是目前一個不可避免的話題,道路交通事故的責任認定也隨之成為社會關注的熱點問題。隨著國家綜合實力的增強、法制的健全、國民法制意識的提高,交通事故涉及的民事和刑事訴訟案件逐年增加,使得交警部門及其它相關部門的工作量大量增加、工作難度大量提高?茖W、準確、快速地分析道路交通事故成為辦案人員與事故當事人的共同目標。 本文以道路交通事故車速鑒定為研究對象,針對目前車速鑒定證據(jù)的多樣性和多學科性特點,對車速鑒定方法進行分析和研究。首先,通過對傳統(tǒng)的基于物證痕跡的車速鑒定方法進行探討,將其歸納為根據(jù)理論公式計算法、實驗分析法、人體損傷程度分析法、事故再現(xiàn)軟件計算法等,并就這些方法進行了闡述和比較,便于這些方法在實際中的應用。其次,針對基于視頻的車速鑒定方法進行了研究,探討了視頻證據(jù)多樣性的特點,討論了視頻文件格式、相應播放器軟件的技術問題,分析了特征點和參照物的選取方法,給出了基于視頻的車速鑒定的基本原則和具體步驟,為實際鑒定工作提供了指導。然后,對基于電子數(shù)據(jù)的車速鑒定方法進行了分析,闡述了電子數(shù)據(jù)存儲的原理,分析了電子數(shù)據(jù)的獲取的方式和應用。同時,對于上述三種方法,給出了多個實際案例的分析和計算,從而對各自方法的應用加以說明并進行了討論。最后,,討論了基于多鐘途徑的車速鑒定方法的綜合應用問題,結合實例,提出了采用不同方法進行鑒定的一些基本原則。研究工作對于確保車速鑒定的科學性和準確性具有一定的理論指導和實際意義。
[Abstract]:With the rapid development of our society, the increase of road mileage and the continuous improvement of vehicle ownership, the total number of road traffic accidents is high. Road traffic safety is an inevitable topic at present, and the responsibility of road traffic accidents has become a hot issue of social concern. With the strengthening of the comprehensive strength of the country, the perfection of the legal system, the improvement of the awareness of the national legal system, and the increasing number of civil and criminal litigation cases involved in traffic accidents, the workload of traffic police departments and other related departments has increased substantially. The difficulty of the work has been greatly increased. Scientific, accurate and rapid analysis of road traffic accidents has become the common goal of case handlers and accident parties. In this paper, the vehicle speed identification of road traffic accidents as the research object, according to the diversity and multidisciplinary characteristics of the current speed identification evidence, the speed identification method is analyzed and studied. First of all, by discussing the traditional method of speed identification based on physical evidence trace, it can be concluded into calculation method based on theoretical formula, experimental analysis method, human body injury degree analysis method, accident reappearance software calculation method, etc. These methods are described and compared in order to facilitate the application of these methods in practice. Secondly, the method of speed identification based on video is studied, the characteristics of diversity of video evidence are discussed, the format of video file and the technical problems of corresponding player software are discussed, and the selection method of feature points and reference objects is analyzed. The basic principles and steps of speed identification based on video are given, which provide guidance for practical identification. Then, the method of speed identification based on electronic data is analyzed, the principle of electronic data storage is expounded, and the way of obtaining electronic data and its application are analyzed. At the same time, for the above three methods, the analysis and calculation of many practical cases are given, and the application of each method is explained and discussed. Finally, the comprehensive application of multi-clock approach to speed identification is discussed, and some basic principles for different methods are put forward. The research work has certain theoretical guidance and practical significance to ensure the scientific and accuracy of speed identification.
