【摘要】：公平正義是人類亙古不變的價值訴求之一,現(xiàn)代文明社會的發(fā)展不斷擴大著社會正義的領(lǐng)域,如今經(jīng)濟發(fā)展背后的環(huán)境問題逐漸成為正義訴求的新的曠野。近年來我國經(jīng)濟建設(shè)的不斷發(fā)展,隨之而來的環(huán)境污染,以及環(huán)境治理過程中存在的分配差異問題,給我國現(xiàn)代化進程中的環(huán)境政策優(yōu)化帶來極大挑戰(zhàn),制約著我國生態(tài)文明社會的構(gòu)建。為此,本文從環(huán)境正義理論的視角,對我國環(huán)境政策中的正義關(guān)懷進行分析。緒論部分總結(jié)了當(dāng)前環(huán)境政策研究狀況,隨后對環(huán)境正義理論進行闡述,指出我國當(dāng)前環(huán)境政策優(yōu)化中的環(huán)境正義訴求。第一部分通過梳理我國建國以來環(huán)境政策的發(fā)展歷程,分析了我國環(huán)境政策發(fā)展中不同時期的工作重點,以及我國環(huán)境政策幾十年來所取得的實際成效。第二部分在上述基礎(chǔ)上,分析了環(huán)境正義在我國環(huán)境政策優(yōu)化過程中的體現(xiàn)。本章從國內(nèi)環(huán)境正義、國際環(huán)境正義和代際環(huán)境正義三個維度,針對我國面臨的不同類型的環(huán)境問題進行研究,指出我國環(huán)境政策是如何在優(yōu)化過程中對這些問題作出回應(yīng)的,并著重對我國因城鄉(xiāng)差異、地域差異等因素造成的環(huán)境保護工作中的是否公正進行了討論。第三部分分析了當(dāng)前我國環(huán)境政策中的不足之處,指出我國當(dāng)前政策在平等對待不同地區(qū)和群體方面還有待完善,在借鑒從政府、企業(yè)和公眾三個方面對我國環(huán)境政策在生態(tài)補償、公眾參與等方面的優(yōu)化提出建議。
[Abstract]:Fairness and justice is one of the immutable values of human beings. The development of modern civil society is expanding the field of social justice. Now the environmental problems behind the economic development have gradually become the new wilderness of justice demands. In recent years, the unceasing development of our country's economic construction, the following environmental pollution, as well as the distribution difference in the process of environmental management, bring great challenges to the optimization of the environmental policy in the process of our country's modernization. It restricts the construction of ecological civilization society in our country. Therefore, from the perspective of environmental justice theory, this paper analyzes the concern of justice in China's environmental policy. The introduction summarizes the current research situation of environmental policy, then expounds the theory of environmental justice, and points out the demand of environmental justice in the optimization of environmental policy in our country. In the first part, by combing the development course of environmental policy since the founding of the people's Republic of China, the author analyzes the emphases of the environmental policy development in different periods and the actual effect of the environmental policy in our country in recent decades. The second part analyzes the embodiment of environmental justice in the process of environmental policy optimization. From the three dimensions of domestic environmental justice, international environmental justice and intergenerational environmental justice, this chapter studies different types of environmental problems faced by our country, and points out how our environmental policy responds to these problems in the process of optimization. The justice of environmental protection caused by the differences between urban and rural areas and regions in China is also discussed. The third part analyzes the deficiencies of the current environmental policy in China, and points out that the current policy of our country needs to be improved in the equal treatment of different regions and groups. Enterprises and the public put forward suggestions on the optimization of environmental policy in ecological compensation and public participation.
