【摘要】："垃圾圍城"現(xiàn)象在全國范圍的出現(xiàn)和蔓延,有其重要的緣由,垃圾治理相關政策效能缺失是重要的根源之一,具體體現(xiàn)為程序性、交易性、實質(zhì)性和規(guī)范性效能缺失。而破解這一問題的出路就在于建構(gòu)起可持續(xù)、可復制的治理結(jié)構(gòu):制度結(jié)構(gòu)的構(gòu)建,可為"垃圾圍城"治理提供穩(wěn)定和可持續(xù)的保障;關系結(jié)構(gòu)的構(gòu)建,可為"垃圾圍城"治理提供合作共治的模式;具象結(jié)構(gòu)的構(gòu)建,可為"垃圾圍城"治理提供有效的行動網(wǎng)絡;聯(lián)盟結(jié)構(gòu)的構(gòu)建,可為"垃圾圍城"治理提供經(jīng)驗累積。在推進和實施過程中,應從多維度的視角出發(fā),綜合施策,標本兼治:完善垃圾治理的相關政策,創(chuàng)新垃圾治理方式;培育統(tǒng)一開放、競爭有序的垃圾市場環(huán)境,為企業(yè)盈利提供多元化渠道;通過法律法規(guī)賦予社區(qū)垃圾治理職責,探索社區(qū)垃圾治理職責的實現(xiàn)形式;建立和完善鄉(xiāng)村和城市垃圾治理資金籌集機制;完善社會信用體系,強化執(zhí)法力度,簡化訴訟和審判流程,保證懲戒機制發(fā)揮實質(zhì)性作用。
[Abstract]:The phenomenon of "garbage siege" has appeared and spread throughout the country. It has its important reason. The lack of policy effectiveness related to garbage management is one of the important sources, which is embodied in procedural, transactional, substantive and normative effectiveness. The solution to this problem lies in the construction of a sustainable and replicable governance structure. The construction of the structure can provide a stable and sustainable guarantee for the "garbage siege" governance; the construction of the relationship structure can provide a cooperative co governance model for the "garbage siege" governance; the construction of the concrete structure can provide an effective action network for the "garbage siege" governance; the construction of the alliance structure can provide experience accumulation for the "garbage besieged city" governance. In the process of entering and implementing, we should proceed from the perspective of multidimensional, comprehensive policy, sample and treatment: improve the relevant policies of garbage management, innovate the way of garbage disposal, cultivate the unified and open and competitive garbage market environment, provide diversified channels for the profit of the enterprises, and explore the treatment of community garbage by law laws and regulations, and explore the treatment of community garbage. The realization form of the responsibility, the establishment and improvement of the rural and urban garbage disposal fund raising mechanism, the improvement of the social credit system, the strengthening of law enforcement, the simplification of litigation and trial process, and the guarantee of the substantive role of the disciplinary mechanism.
