【摘要】：生態(tài)文明建設(shè)是“中國(guó)夢(mèng)”的有機(jī)構(gòu)成之一,在實(shí)現(xiàn)這個(gè)夢(mèng)的過(guò)程中,我們每一位個(gè)體都當(dāng)義不容辭。建設(shè)美麗中國(guó)需要廣大人民群眾的廣泛參與,這是邁入社會(huì)主義生態(tài)文明的必然之舉。生態(tài)文明建設(shè)必將是一個(gè)長(zhǎng)期的歷史過(guò)程,其道路漫長(zhǎng)而艱巨,公眾參與面臨種種困難將不言而喻。為了生態(tài)文明建設(shè)的積極與有序推進(jìn),建立生態(tài)文明制度,尤其是建立健全完善的生態(tài)文明建設(shè)公眾參與機(jī)制意義深遠(yuǎn)。其一方面有利于緩解當(dāng)前嚴(yán)峻的生態(tài)形勢(shì)；另一方面又可以維護(hù)和實(shí)現(xiàn)公眾的生態(tài)權(quán)益,調(diào)控公眾的生態(tài)行為。盡管當(dāng)前關(guān)于生態(tài)文明制度研究的文獻(xiàn)已很多,但是關(guān)于生態(tài)文明建設(shè)中公眾參與機(jī)制的研究還頗為不足。因此,加強(qiáng)生態(tài)文明建設(shè)中公眾參與機(jī)制研究,無(wú)論在理論上還是在實(shí)踐應(yīng)用中都具有十分重要的價(jià)值。文章就是在此基礎(chǔ)上展開(kāi)分析的,其主要內(nèi)容由以下幾部分組成：第一部分：緒論。這部分主要闡述了本選題的背景與意義、國(guó)內(nèi)外研究綜述、研究的思路與方法、重點(diǎn)難點(diǎn)和創(chuàng)新點(diǎn)。第二部分：生態(tài)文明建設(shè)與公眾參與機(jī)制概述。這部分主要就生態(tài)文明的含義,生態(tài)文明建設(shè)的理論依據(jù)、目標(biāo)、內(nèi)容、原則；生態(tài)文明建設(shè)下公眾參與機(jī)制的含義、特征、理論依據(jù)；生態(tài)文明建設(shè)中公眾參與的必要性等做了一個(gè)概述性的分析。第三部分：生態(tài)文明建設(shè)中公眾參與機(jī)制的現(xiàn)狀分析。這部分主要就國(guó)外一些國(guó)家生態(tài)文明建設(shè)中公眾參與的實(shí)踐、經(jīng)驗(yàn)和我國(guó)生態(tài)文明建設(shè)下公眾參與機(jī)制的客觀現(xiàn)狀等做了歸納和梳理。第四部分：我國(guó)生態(tài)文明建設(shè)中公眾參與機(jī)制生成的制約因素。這部分主要從政治、法律和社會(huì)三個(gè)視角對(duì)我國(guó)生態(tài)文明建設(shè)中公眾參與機(jī)制存在缺陷的原因做了一個(gè)系統(tǒng)的分析。第五部分：強(qiáng)化與完善我國(guó)生態(tài)文明建設(shè)中公眾參與機(jī)制的思考。這部分主要在前文分析的基礎(chǔ)上,從公眾參與的政治、法律、社會(huì)三大機(jī)制入手,就建立與完善生態(tài)文明建設(shè)中公眾參與的決策機(jī)制、合作機(jī)制、問(wèn)責(zé)機(jī)制、法律保障、司法機(jī)制、環(huán)境公益訴訟以及生態(tài)監(jiān)督機(jī)制、教育機(jī)制、平臺(tái)機(jī)制、獎(jiǎng)懲機(jī)制和評(píng)價(jià)機(jī)制等做出了較為全面的對(duì)策性的思考和探究。
[Abstract]:The construction of ecological civilization is one of the organic components of the "Chinese dream". In the process of realizing this dream, every one of us is bound to be obliged. Building a beautiful China needs extensive participation of the masses. This is an inevitable move for the socialist ecological civilization. The construction of the ecological text will be a long-term historical process. The road is long and arduous, and the public participation in the face of various difficulties will be self-evident. In order to promote the construction of ecological civilization actively and orderly, the establishment of an ecological civilization system, especially the establishment of a sound and perfect ecological civilization construction public participation mechanism is of far-reaching significance. To maintain and realize the ecological rights and interests of the public and to control the ecological behavior of the public, although there are many literature on the study of the ecological civilization system, the research on the public participation mechanism in the construction of ecological civilization is still quite inadequate. Therefore, it is necessary to strengthen the study of the public participation mechanism in the construction of ecological civilization, both in theory and in practice. The main content of the article is to carry out the analysis on this basis. The main content of the article is composed of the following parts: the first part: introduction. This part mainly expounds the background and significance of the topic, the domestic and foreign research review, the thought and method of the research, the point and the difficulty and the innovation point. The second part: the ecological civilization construction This part mainly discusses the meaning of ecological civilization, the theoretical basis of the construction of ecological civilization, the objective, the content, the principle, the meaning, the characteristics, the theoretical basis of the public participation mechanism under the construction of ecological civilization, the necessity of public participation in the construction of ecological civilization, and the third part: Ecology The analysis of the present situation of public participation mechanism in the construction of civilization. This part mainly summarizes and combs the practice of public participation in the construction of ecological civilization in some countries, experience and the objective status of public participation mechanism under the construction of ecological civilization in our country. The fourth part: the restriction of the generation of public participation mechanism in the construction of ecological civilization in China This part makes a systematic analysis of the reasons for the defects of the public participation mechanism in the construction of ecological civilization in China from three perspectives of politics, law and society. The fifth part: strengthening and perfecting the public participation mechanism in the construction of ecological civilization in our country. Starting with the three major mechanisms of politics, law and society, it makes a comprehensive and Countermeasure Thinking on establishing and perfecting the decision-making mechanism of public participation in the construction of ecological civilization, cooperation mechanism, accountability mechanism, legal guarantee, judicial mechanism, environmental public interest litigation and ecological supervision mechanism, education mechanism, platform mechanism, prize punishment mechanism and evaluation mechanism.
