【摘要】：隨著我國長江流域經(jīng)濟的快速發(fā)展,化工品和能源的需求增長迅速,大量具有易燃、毒害等特性的危險化學(xué)品不斷問世,而這些�；分饕陨⒀b液體危險貨物的形式通過長江運輸?shù)窖鼐�各化工園區(qū)和倉儲基地。大量有毒、有害的散裝液體危險貨物運輸給長江生態(tài)環(huán)境和沿線城市居民的用水安全帶來了嚴重威脅。本文從船載散裝液體危險貨物的特性及其對水體的污染形式出發(fā),介紹我國目前長江散裝液體危險貨物運輸監(jiān)管方面的發(fā)展現(xiàn)狀。著重分析研究了長江散裝液體危險貨物運輸監(jiān)管相關(guān)的法律規(guī)范,行政管理部門的管理體制、監(jiān)管模式、效能、技術(shù)手段,社會企業(yè)參與管理的情況三個方面所存在的問題。參考西方發(fā)達國家先進經(jīng)驗,運用公共選擇和公共安全管理相關(guān)理論及方法,分析研究我國目前長江散裝液體危險貨物監(jiān)管在法律規(guī)范、管理部門、社會企業(yè)參與度方面相對不足的原因,并提出相應(yīng)對策方案,以完善我國長江散裝液體危險貨物運輸監(jiān)管體系。本論文提出的對策建議包括:建議針對長江生態(tài)環(huán)境的保護和流域經(jīng)濟的發(fā)展進行專門立法;完善長江散裝液體危險貨物運輸?shù)墓芾眢w制;改革現(xiàn)有監(jiān)管模式,在長江水域建立綜合管理部門,統(tǒng)一執(zhí)法等宏觀對策。同時提出了在具體管理方面:建議主管部門要提升執(zhí)法效能;利用信息化手段建立散裝液體危險貨物運輸監(jiān)管的大數(shù)據(jù)平臺,并實現(xiàn)數(shù)據(jù)共享;要發(fā)揮相關(guān)社會組織作用促進散裝液體危險貨物航運市場良性發(fā)展。
[Abstract]:With the rapid development of the economy in the Yangtze River Valley, the demand for chemical products and energy is growing rapidly, and a large number of dangerous chemicals with the characteristics of flammability and toxicity have been coming out.These dangerous chemicals are mainly transported through the Yangtze River in the form of bulk liquid dangerous goods to various chemical parks and storage bases along the route.A large number of toxic and harmful bulk liquid dangerous goods transportation has brought serious threat to the ecological environment of Yangtze River and the water safety of urban residents along the Yangtze River.Based on the characteristics of carrier bulk liquid dangerous goods and its pollution to water body, this paper introduces the development of transport supervision of bulk liquid dangerous goods in Yangtze River at present in China.This paper emphatically analyzes and studies the problems existing in three aspects of the regulation of the transport of the Yangtze River bulk liquid dangerous goods, the management system of the administrative department, the supervision model, the efficiency, the technical means and the situation of the social enterprises participating in the management.Referring to the advanced experience of western developed countries, using the relevant theories and methods of public choice and public safety management, this paper analyzes and studies the supervision and control departments of bulk liquid dangerous goods in the Yangtze River in China at present.In order to perfect the supervision system of bulk liquid dangerous goods transportation of Yangtze River, this paper puts forward the relative countermeasures for the reasons of the relatively insufficient participation of social enterprises.The countermeasures and suggestions in this paper include: making special legislation for the protection of the ecological environment of the Yangtze River and the development of the river basin economy; perfecting the management system of the transportation of the Yangtze River bulk liquid dangerous goods; reforming the existing regulatory model.In the Yangtze River waters to establish a comprehensive management department, unified law enforcement and other macro countermeasures.At the same time, it puts forward the following aspects: to improve the efficiency of law enforcement, to establish big data platform for the transport supervision of bulk liquid dangerous goods by means of information technology, and to realize data sharing;To give play to the role of relevant social organizations to promote the healthy development of bulk liquid dangerous goods shipping market.
