基于風(fēng)險(xiǎn)管理理論的政府安全生產(chǎn)監(jiān)管模式研究

【摘要】:安全生產(chǎn)關(guān)系到國(guó)家、人民的根本利益,關(guān)系到社會(huì)發(fā)展改革、穩(wěn)定和諧的大局,是我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)穩(wěn)定、持續(xù)、快速、健康發(fā)展的根本保證,也是社會(huì)主義發(fā)展生產(chǎn)力最根本的要求,,受到了黨和國(guó)家各級(jí)政府一直以來(lái)的高度重視。安全生產(chǎn)監(jiān)管工作有效的開(kāi)展,促進(jìn)了安全生產(chǎn)形勢(shì)的穩(wěn)定,為經(jīng)濟(jì)建設(shè)創(chuàng)造了安全健康的環(huán)境基礎(chǔ),也是建設(shè)和諧社會(huì)宏的重要內(nèi)容。 我國(guó)實(shí)行安全生產(chǎn)責(zé)任制和責(zé)任追究制度,各級(jí)政府有關(guān)職能部門(mén)屬于安全生產(chǎn)監(jiān)管的責(zé)任主體,應(yīng)該依法承擔(dān)起本轄區(qū)內(nèi)的安全生產(chǎn)監(jiān)管責(zé)任,也是政府對(duì)企業(yè)實(shí)行安全生產(chǎn)監(jiān)督管理具體的實(shí)施單位。然而,面對(duì)復(fù)雜嚴(yán)峻的安全生產(chǎn)形勢(shì),現(xiàn)行的安全生產(chǎn)監(jiān)管模式存在很多不適應(yīng),一方面安監(jiān)部門(mén)執(zhí)法力量不足。有限的安監(jiān)機(jī)構(gòu)人力資源與點(diǎn)多面廣的監(jiān)管任務(wù)之間存在較為突出的矛盾。另一方面,安監(jiān)隊(duì)伍的執(zhí)法能力參差不齊,人員素質(zhì)不能滿足安全生產(chǎn)執(zhí)法技術(shù)性、專(zhuān)業(yè)性、法制性的要求。因此,各級(jí)政府應(yīng)當(dāng)建立有效、科學(xué)且針對(duì)政府層面的一套安全生產(chǎn)監(jiān)管模式。 本論文借鑒生產(chǎn)企業(yè)風(fēng)險(xiǎn)監(jiān)管模式相關(guān)的理論和方法,建立政府安全生產(chǎn)風(fēng)險(xiǎn)監(jiān)管模式。主要研究?jī)?nèi)容有: (1)政府安全生產(chǎn)監(jiān)管模式的現(xiàn)狀問(wèn)題、存在不足和研究目的:說(shuō)明本論文的研究背景、意義、內(nèi)容以及思路,并對(duì)研究該問(wèn)題所涉及到的基本概念和相關(guān)研究方法進(jìn)行闡述。 (2)安全生產(chǎn)風(fēng)險(xiǎn)管理的理論基礎(chǔ):重點(diǎn)針對(duì)安全生產(chǎn)風(fēng)險(xiǎn)管理的相關(guān)概念、辨識(shí)危險(xiǎn)有害因素的方法及過(guò)程、風(fēng)險(xiǎn)評(píng)價(jià)方法等進(jìn)行闡述,為研究論文的展開(kāi)做好基礎(chǔ)。 (3)生產(chǎn)企業(yè)風(fēng)險(xiǎn)級(jí)別分類(lèi)評(píng)價(jià):重點(diǎn)研究生產(chǎn)企業(yè)風(fēng)險(xiǎn)級(jí)別分類(lèi)評(píng)價(jià)指標(biāo)體系的結(jié)構(gòu)及建立方法,選取生產(chǎn)企業(yè)風(fēng)險(xiǎn)級(jí)別分類(lèi)方法及指標(biāo)評(píng)價(jià)的方法等,為各級(jí)政府建立風(fēng)險(xiǎn)級(jí)別分類(lèi)方法提供依據(jù)和參考。 (4)政府安全監(jiān)管風(fēng)險(xiǎn)分類(lèi)方法研究:主要研究政府關(guān)于安全生產(chǎn)風(fēng)險(xiǎn)監(jiān)管模式過(guò)程的建立,政府對(duì)安全生產(chǎn)監(jiān)管風(fēng)險(xiǎn)進(jìn)行分級(jí)模型的分析,及政府建立的安全監(jiān)管風(fēng)險(xiǎn)分級(jí)模式,通過(guò)研究,最終建立政府安全生產(chǎn)風(fēng)險(xiǎn)分級(jí)管理的體系。 (5)安全生產(chǎn)風(fēng)險(xiǎn)分級(jí)管理模式實(shí)例應(yīng)用:以萊蕪市為例,選取該市國(guó)有、股份、私營(yíng)三家非煤礦山企業(yè)為代表,對(duì)起進(jìn)行風(fēng)險(xiǎn)等級(jí)評(píng)價(jià),確定風(fēng)險(xiǎn)級(jí)別,從而制定監(jiān)管計(jì)劃。
[Abstract]:Safety of production is related to the fundamental interests of the country and the people, to the reform of social development and to the overall situation of stability and harmony. It is the fundamental guarantee for the stable, sustained, rapid and healthy development of our socialist market economy. Also is the socialist development productive forces the most fundamental request, has received the party and the state all levels government all the time the high attention. The effective development of safety production supervision has promoted the stability of production safety situation, created a safe and healthy environmental foundation for economic construction, and is also an important content of building a harmonious society. China implements the system of responsibility and accountability for production safety, and the relevant functional departments of governments at all levels belong to the main body of responsibility for the supervision of production safety, and shall, according to law, assume the responsibility for supervision of production safety within their respective jurisdictions. Is also the government to implement the safety of production supervision and management of specific implementation units. However, in the face of the complicated and severe situation of production safety, the current mode of production safety supervision has many inadaptability, on the one hand, the law enforcement power of the safety supervision department is insufficient. There is a prominent contradiction between the limited human resources of the safety supervision institutions and the multi-faceted supervision tasks. On the other hand, the law enforcement ability of safety supervision team is not uniform, and the quality of personnel can not meet the requirements of technical, professional and legal requirements of safety production law enforcement. Therefore, governments at all levels should establish an effective, scientific and government level of safety supervision model. This paper uses the theory and method of risk supervision model for reference to establish the government risk supervision model of production safety. The main research contents are as follows: (1) the current situation, shortcomings and research purposes of the mode of government production safety supervision: explain the research background, significance, content and ideas of this paper, And the basic concepts and related research methods involved in the study are expounded. (2) the theoretical basis of risk management in production safety: focusing on the related concepts of risk management in production safety. The methods and processes of identifying dangerous and harmful factors, the methods of risk evaluation and so on are described. In order to make a good foundation for the research of the thesis. (3) the classification and evaluation of the risk level of the production enterprise: the structure and the establishment method of the index system of the classification and evaluation of the risk level of the production enterprise are studied emphatically. The classification method of risk level and the method of index evaluation are selected. To provide the basis and reference for governments at all levels to establish risk classification methods. (4) Research on risk classification methods of government safety supervision: mainly research on the establishment of government risk supervision model for production safety. The government carries on the analysis to the safety production supervision risk classification model, and the safety supervision risk classification model established by the government, through the research, Finally establish the government safety production risk classification management system. (5) Safety production risk classification management model application: Laiwu City as an example, select the city state-owned, shares, private three non-coal mining enterprises as representatives, Evaluate the risk rating, determine the risk level, and then develop the regulatory plan.
