【摘要】：中國(上海)自由貿易試驗區(qū)是為中國參與高標準的國際投資和貿易規(guī)則制定提供先試先行的制度創(chuàng)新。國際化和法治化是上海自貿區(qū)建設的基本理念,由于國際經濟環(huán)境的變化,WTO固有的規(guī)則以及多哈回合談判的議題已經不能滿足外部環(huán)境變化的需要。目前國際貿易規(guī)則的談判已經從過去僅限于貿易領域向投資領域擴展。國際貿易和投資規(guī)則正在由三大方面形成:在WTO多邊貿易體制內,正在推動以《國際服務貿易協(xié)定》(TISA)為代表的復邊談判;在WTO多邊體制外,正在推動以TTP和TTIP為代表的"巨型"(MEGA)的區(qū)域自由貿易協(xié)定的談判;在雙邊領域,以美國2012年雙邊投資協(xié)定(BIT)范本為主導的高標準投資協(xié)定正在進行談判。這些正在進行談判的貿易投資規(guī)則將通過高門檻的談判來形成高標準的貿易投資規(guī)則。中國需未雨綢繆。上海自貿區(qū)的建設需要形成與國際投資、貿易通行規(guī)則相銜接的基本制度框架,必須在投資、貿易、金融和行政等方面按國際化和法治化要求來完善營商環(huán)境。上海自貿區(qū)將因制度創(chuàng)新帶來制度紅利,并通過可復制、可推廣來推動全國范圍的深化改革。
[Abstract]:China (Shanghai) free trade pilot area is a pilot system innovation for China to participate in high standards of international investment and trade rules. Internationalization and rule by law are the basic concepts of the construction of Shanghai Free Trade Zone. Due to the change of international economic environment and the inherent rules of WTO and the issues of Doha Round negotiations, they can no longer meet the needs of the changes in external environment. Negotiations on international trade rules have expanded from trade to investment. International trade and investment rules are being formed in three main ways: within the WTO multilateral trading system, the multi-border negotiations, represented by the International Agreement on Trade in Services (TISA), are being promoted; and outside the WTO multilateral system, Negotiations on "giant" (MEGA) regional free trade agreements, represented by TTP and TTIP, are being promoted; in the bilateral arena, high standards investment agreements, led by the (BIT) model of the United States' 2012 bilateral investment treaty, are being negotiated. These ongoing trade and investment rules will be negotiated through high-threshold negotiations to form high standards of trade and investment rules. China needs to be prepared ahead of time. The construction of Shanghai Free Trade Zone needs to form a basic institutional framework to link up with international investment and general rules of trade. It is necessary to perfect the business environment according to the requirements of internationalization and rule of law in investment, trade, finance and administration. Shanghai Free Trade Zone will bring institutional dividend due to institutional innovation, and can be replicated and popularized to promote the deepening reform of the whole country.
