【摘要】:作為市場(chǎng)經(jīng)濟(jì)重要組成部分,非公有制經(jīng)濟(jì)為我國(guó)經(jīng)濟(jì)發(fā)展起到了至關(guān)重要的作用。但是,目前非公有制經(jīng)濟(jì)自身存在的一些不和諧因素,尤其是勞資關(guān)系的不和諧問題嚴(yán)重制約了非公有制經(jīng)濟(jì)的發(fā)展。因此,當(dāng)前實(shí)現(xiàn)非公有制經(jīng)濟(jì)和諧勞資關(guān)系的構(gòu)建具有重要現(xiàn)實(shí)意義,它不僅有利于推動(dòng)社會(huì)主義和諧社會(huì)的實(shí)現(xiàn),而且還能夠使其很好地應(yīng)對(duì)全球化帶來的挑戰(zhàn),從而保證非公有制經(jīng)濟(jì)自身健康快速的發(fā)展。 在分析我國(guó)非公有制經(jīng)濟(jì)構(gòu)建和諧勞資關(guān)系中需要以馬克思主義理論為指導(dǎo)。馬克思主義勞資關(guān)系理論體系至今依然是研究我國(guó)非公有制經(jīng)濟(jì)勞資關(guān)系的理論前提。有了理論指導(dǎo)還需要實(shí)踐依據(jù)。實(shí)現(xiàn)非公有制經(jīng)濟(jì)和諧勞資關(guān)系的構(gòu)建,也正是在總結(jié)我國(guó)非公有制經(jīng)濟(jì)發(fā)展過程中處理勞資關(guān)系的經(jīng)驗(yàn)教訓(xùn)及借鑒西方國(guó)家處理勞資關(guān)系理論和經(jīng)驗(yàn)的基礎(chǔ)上展開的。 非公有制經(jīng)濟(jì)已經(jīng)成為我國(guó)國(guó)民經(jīng)濟(jì)的重要組成部分,但是快速發(fā)展的同時(shí)勞動(dòng)與資本的矛盾不斷顯性化,侵犯勞動(dòng)者權(quán)益的問題時(shí)有發(fā)生。其中突出問題是勞動(dòng)者工資分配制度不公正、社會(huì)保障制度落實(shí)差、工會(huì)行政色彩濃烈導(dǎo)致維權(quán)職責(zé)弱化、勞資爭(zhēng)議案件增多導(dǎo)致處理難度加大等。從我國(guó)目前勞資沖突行為的性質(zhì)來看,,多數(shù)是由于勞動(dòng)者的基本勞動(dòng)權(quán)益被侵害,而又長(zhǎng)期得不到解決所致。 非公有制經(jīng)濟(jì)構(gòu)建和諧勞資關(guān)系需要政府在政治導(dǎo)向、經(jīng)濟(jì)建設(shè)、監(jiān)督管理、公共服務(wù)等方面做到主導(dǎo)作用,以宏觀的方式推動(dòng)和諧勞資關(guān)系的形成促進(jìn)和諧社會(huì)的構(gòu)建。企業(yè)主提高對(duì)構(gòu)建和諧勞資關(guān)系的積極性是經(jīng)濟(jì)健康快速發(fā)展的重要保證,也是建設(shè)社會(huì)主義和諧社會(huì)的大事。提高勞動(dòng)者的自身素質(zhì),這不僅影響到個(gè)人利益的保證而且關(guān)系到非公有制經(jīng)濟(jì)的穩(wěn)定發(fā)展。建立健全勞資協(xié)調(diào)機(jī)制,調(diào)節(jié)勞資關(guān)系,維護(hù)勞動(dòng)者權(quán)益,能夠積極促進(jìn)非公有制經(jīng)濟(jì)穩(wěn)定發(fā)展。加強(qiáng)非公有制經(jīng)濟(jì)中勞資關(guān)系的法制建設(shè)和法律調(diào)整,保障和諧勞資關(guān)系的構(gòu)建。
[Abstract]:As an important part of market economy, non-public economy plays a vital role in the economic development of our country. However, at present, some disharmonious factors exist in non-public economy, especially the disharmony between labor and capital, which seriously restricts the development of non-public economy. Therefore, the current realization of harmonious labor relations in non-public economy has important practical significance. It is not only conducive to promoting the realization of a harmonious socialist society, but also able to meet the challenges brought by globalization. So as to ensure that the non-public economy itself healthy and rapid development. Marxism theory should guide the construction of harmonious labor relations in non-public-owned economy of our country. The theoretical system of Marxist labor-capital relations is still the theoretical premise of studying labor-capital relations in non-public-owned economy. Theoretical guidance also needs practical basis. The construction of harmonious labor relations in non-public economy is based on summing up the experience and lessons of dealing with labor relations in the process of development of non-public ownership economy of our country and drawing lessons from the theories and experiences of dealing with labour relations in western countries. Non-public economy has become an important part of our national economy, but with the rapid development of labor and capital, the contradiction between labor and capital is becoming more and more dominant, and the problem of infringing workers' rights and interests occurs from time to time. The prominent problems are the unfair wage distribution system, the poor implementation of social security system, the weakening of labor rights duties due to the strong administrative color of trade unions, and the increasing number of labor disputes resulting in more difficult to deal with, and so on. Judging from the nature of labor conflicts in our country, most of them are caused by the violation of workers' basic labor rights and interests, and the fact that they have not been solved for a long time. The construction of harmonious labor relations in non-public economy requires the government to play a leading role in political orientation, economic construction, supervision and management, public service and so on, and to promote the formation of harmonious labor relations and the construction of harmonious society in a macro way. It is an important guarantee for the healthy and rapid development of economy to improve the enthusiasm of business owners to build harmonious labor relations, and is also a major event in building a harmonious socialist society. The improvement of laborer's own quality not only affects the guarantee of personal benefit but also relates to the steady development of non-public economy. Establishing and perfecting the coordination mechanism of labor and capital, regulating labor relations and safeguarding workers' rights and interests can actively promote the steady development of non-public economy. Strengthen the legal construction and legal adjustment of labor relations in non-public economy, and guarantee the construction of harmonious labor relations.
