網(wǎng)絡(luò)技術(shù)背景下個人隱私權(quán)問題研究

【摘要】：網(wǎng)絡(luò)技術(shù)的迅猛發(fā)展使社會的政治、經(jīng)濟、文化、教育、科技等領(lǐng)域發(fā)生了深刻的變化，給人類的生活帶來了極大的便利。然而，網(wǎng)絡(luò)給人類帶來了繁榮、便利，同時也打破了傳統(tǒng)隱私權(quán)屏障的時間、空間界限，給人們生活方式和價值觀念帶來極大沖擊。網(wǎng)絡(luò)不僅可以使人們自由的查詢和使用網(wǎng)上所有資料，還可以跟蹤、記錄和存儲每個人在網(wǎng)上的各種活動。網(wǎng)絡(luò)的公開性、易窺竊性、不安全性很容易使人們的隱私暴露于天下，使個人信息遭到不當(dāng)?shù)氖占鞑ズ屠�，人們安寧的生活遭到�?yán)重困擾。在網(wǎng)絡(luò)技術(shù)背景下，侵犯個人隱私權(quán)事件頻頻發(fā)生，而且愈演愈烈，人們不得不謹(jǐn)小慎微。網(wǎng)絡(luò)社會，，保護好個人隱私不被他人侵犯，是目前急需解決的事情。 本文首先列出了網(wǎng)絡(luò)隱私權(quán)受到侵害的現(xiàn)狀，并且從現(xiàn)象入手，對其根源進行深入分析。首先，網(wǎng)絡(luò)技術(shù)為人類開拓了無限廣闊的生存空間，人們通過網(wǎng)絡(luò)技術(shù)可以更加健康、更加自由的溝通和交流，但是，由于人們對網(wǎng)絡(luò)技術(shù)的不當(dāng)使用，對網(wǎng)絡(luò)自由的過渡追求、為所欲為，給個人隱私帶來了前所未有沖擊和挑戰(zhàn)，使網(wǎng)絡(luò)技術(shù)發(fā)生異化。其次，技術(shù)是由人類創(chuàng)造，技術(shù)的運用掌握在人類自己手中，對其“善”或“惡”的運用完全靠人類自身的價值取向，然而，道德標(biāo)準(zhǔn)決定了人類的價值取向。在當(dāng)今網(wǎng)絡(luò)社會，網(wǎng)絡(luò)主體價值標(biāo)準(zhǔn)出現(xiàn)偏差，網(wǎng)絡(luò)社會道德規(guī)范體系缺失以及巨大商業(yè)利益的驅(qū)使，是網(wǎng)絡(luò)主體的道德失范，隱私權(quán)遭到侵害的根源。最后，政府對網(wǎng)絡(luò)監(jiān)管的不完善，特別是我國在網(wǎng)絡(luò)監(jiān)管方面仍存在不少缺陷。例如，在網(wǎng)絡(luò)監(jiān)管技術(shù)方面，網(wǎng)絡(luò)隱私權(quán)保護的法律法規(guī)方面，以及網(wǎng)絡(luò)監(jiān)管的執(zhí)行機制方面都不完善，也很容易使網(wǎng)絡(luò)隱私權(quán)受到侵犯。 文章最后，提出了完善網(wǎng)絡(luò)隱私權(quán)保護的相關(guān)對策。首先要完善網(wǎng)絡(luò)隱私權(quán)保護的技術(shù)體系，開發(fā)更加先進的網(wǎng)絡(luò)技術(shù)，增加網(wǎng)絡(luò)的安全性，為保護網(wǎng)絡(luò)隱私權(quán)提供強大的技術(shù)后盾。然而技術(shù)不是萬能的，保護網(wǎng)絡(luò)隱私權(quán)，需要強化網(wǎng)絡(luò)社會的道德約束，提高網(wǎng)絡(luò)主體的道德修養(yǎng)，培養(yǎng)網(wǎng)民的自律意識。此外，還需要加強行業(yè)自律性建設(shè)，加強政府對網(wǎng)絡(luò)監(jiān)管的法律規(guī)制，加強國際協(xié)作，全方位多角度同時采取措施，進行“綜合治理”。只有這樣，網(wǎng)絡(luò)隱私權(quán)問題才能徹底解決，互聯(lián)網(wǎng)才會朝著積極向上、和諧健康的方向發(fā)展。
[Abstract]:With the rapid development of network technology, profound changes have taken place in the fields of politics, economy, culture, education, science and technology, which have brought great convenience to human life. However, the Internet has brought prosperity and convenience to human beings, and it has also broken the time and space boundaries of traditional privacy barriers, which has brought a great impact on people's way of life and values. The network not only allows people to freely search and use all the information on the Internet, but also tracks, records and stores all kinds of activities of everyone on the Internet. It is easy to expose people's privacy to the world because of its openness, easy to pry, and insecurity, which makes personal information collected, spread and utilized improperly, and the peaceful life of people is seriously perplexed. In the background of network technology, violations of personal privacy occur frequently, and more intense, people have to be cautious. Network society, protect personal privacy from being infringed by others, it is urgent to solve at present. This paper first lists the status quo of network privacy infringement, and from the phenomenon, the root of the in-depth analysis. First of all, network technology has opened up infinite living space for human beings. People can communicate and communicate more healthily and freely through network technology. However, due to the improper use of network technology by people, The transition pursuit of network freedom brings unprecedented impact and challenge to personal privacy and alienation of network technology. Secondly, technology is created by human beings. The use of technology is in the hands of human beings, and the use of "good" or "evil" depends entirely on the value orientation of human beings. However, moral standards determine the value orientation of human beings. In today's network society, the deviation of the value standard of the network subject, the lack of the system of moral norms in the network society and the drive of the huge commercial interests are the root causes of the violation of the privacy right of the network subject and the moral derangement of the network subject. Finally, the government does not perfect the network supervision, especially in our country, there are still many defects in the network supervision. For example, in the aspect of network supervision technology, the laws and regulations of network privacy protection, as well as the enforcement mechanism of network supervision are not perfect, and it is easy to infringe the network privacy. Finally, the paper puts forward some countermeasures to improve the protection of network privacy. First of all, it is necessary to perfect the technical system of network privacy protection, to develop more advanced network technology, to increase the security of network, and to provide strong technical backing for the protection of network privacy. However, technology is not omnipotent. To protect the privacy of the network, it is necessary to strengthen the moral restraint of the network society, improve the moral accomplishment of the network subject, and cultivate the self-discipline consciousness of the netizens. In addition, it is necessary to strengthen the self-discipline construction of the industry, strengthen the legal regulation of the government on the network supervision, strengthen the international cooperation, and take measures at the same time from various angles to carry out "comprehensive governance". Only in this way, the network privacy problem can be thoroughly solved, the Internet will be positive, harmonious and healthy development.
