【摘要】：無證照經(jīng)營是現(xiàn)階段存在的客觀現(xiàn)象,與我國政治、經(jīng)濟(jì)和社會(huì)發(fā)展程度有著非常密切的關(guān)系,然而無證照經(jīng)營不但有其損害社會(huì)公平性的一面,還存在安全生產(chǎn)隱患,雖然國家和各省對無證照經(jīng)營出臺了不少法律法規(guī)進(jìn)行引導(dǎo)和管制,各地政府也下大氣力進(jìn)行整治,但始終未能徹底解決。自2014年元旦起,廣州市P區(qū)實(shí)施了商事登記制度改革,經(jīng)過這場從地方先行先試的自下而上的變革,P區(qū)政府將商事主體的管理模式從“重審批輕監(jiān)管”轉(zhuǎn)變?yōu)椤皩掃M(jìn)嚴(yán)管”,使整治無證照工作和以往的做法發(fā)生巨大變化,一是整治無證照經(jīng)營的職能從工商部門一個(gè)部門單獨(dú)承擔(dān)轉(zhuǎn)變?yōu)楦髀毮懿块T各負(fù)其責(zé)、協(xié)同配合,二是市場準(zhǔn)入的門檻大幅降低,三是辦理證照非常高效。從而引導(dǎo)了商事主體領(lǐng)取營業(yè)執(zhí)照以及獲得行政許可,將大量無證照經(jīng)營納入規(guī)范管理,有力推進(jìn)了整治無證照經(jīng)營工作。而每一種制度都不是完美的,存在諸多問題,包括法律法規(guī)未完善、監(jiān)管機(jī)制亟待進(jìn)一步健全、部門溝通需要進(jìn)一步加強(qiáng)等,均需要以整體的目光、辯證的思維提出對策,而且對策要符合實(shí)際,具有行之有效、具可操作性的特點(diǎn)。本文以廣州市P區(qū)為例,經(jīng)過商事登記制度改革的市場環(huán)境內(nèi),研究無證照經(jīng)營整治工作遇到的問題和困難,比較分析國內(nèi)外無證照經(jīng)營的管理情況,找出差距與參考價(jià)值,并對P區(qū)的具體情況進(jìn)行調(diào)查和研究,為探索商事登記改革背景下,整治無證照經(jīng)營的新工作模式進(jìn)行探索研究。本文對解決無證照整治中遇到的客觀問題,加強(qiáng)市場監(jiān)督管理,建設(shè)安全運(yùn)行、公平有序、和諧共贏的市場經(jīng)營環(huán)境和提高政府的社會(huì)管理水平、推動(dòng)社會(huì)誠信體系具有研究的現(xiàn)實(shí)意義。
[Abstract]:The operation without license is an objective phenomenon existing at the present stage, and has a very close relationship with the degree of political, economic and social development in our country. However, the management without license not only has its side of harming social fairness, but also has hidden dangers of safety in production. Although the state and provinces have issued a lot of laws and regulations to guide and regulate the operation of the license, the local governments have also exerted great efforts to rectify, but they have never been able to solve the problem thoroughly. Since New Year's Day began in 2014, the P District of Guangzhou has implemented the reform of the commercial registration system. After this bottom-up reform of the local first trial, the P district government has changed the management model of commercial subjects from "emphasizing examination and approval rather than supervision" to "broad-entry and strict management." This has made great changes in the regulation of the work of licensing without certificates and previous practices. One is that the function of regulating the operation of the license has changed from a single department in the industrial and commercial sector to each of the functional departments taking on their respective responsibilities and cooperating with each other. Second, the threshold of market access significantly reduced, the third is very efficient licensing. It leads the commercial subject to obtain the business license and obtain the administrative license, brings a large number of unlicensed management into the standard management, and promotes the regulation of the operation without the license. But each system is not perfect, and there are many problems, including the imperfect laws and regulations, the urgent need for further improvement of the supervision mechanism, the need for further strengthening of departmental communication, and so on, all of which need to put forward countermeasures with the overall vision and dialectical thinking. And the countermeasures should be in line with the reality, with effective, operational characteristics. Taking P District of Guangzhou as an example, in the market environment of commercial registration system reform, this paper studies the problems and difficulties encountered in the management of management without license, compares and analyzes the management situation of management without license at home and abroad, and finds out the gap and reference value. In order to explore the new working mode of regulation without license under the background of the reform of commercial registration, this paper investigates and studies the specific situation of area P. This paper aims at solving the objective problems encountered in the regulation without license, strengthening market supervision and management, building safe operation, fair and orderly market operation environment, harmonious and win-win market management environment and improving the social management level of the government. It is of practical significance to promote the social credit system.
