【摘要】：隨著改革的逐步深入，中國正處于一個社會轉(zhuǎn)型期，在政治、經(jīng)濟、社會、文化發(fā)展均不平衡的條件下，各種矛盾日益顯現(xiàn)，并通過各種方式集聚于各級信訪部門。上海作為中國經(jīng)濟、金融、貿(mào)易和航運中心，在改革開放中發(fā)揮著至關重要的作用。在面對新的歷史條件下不斷出現(xiàn)的新問題、新矛盾，，信訪工作在過多的期望和眾多的矛盾面前，顯現(xiàn)出對時代發(fā)展要求的不適應，遇到了前所未有的尷尬和危機，社會各界不斷對信訪工作引發(fā)爭議。 就目前來看，信訪的產(chǎn)生與存在有其一定的歷史背景，信訪工作在一定時期和一定程度上在聽取各界人士的呼聲，實現(xiàn)社會公平正義等方面起到較為積極作用，其存在具有一定的合理性。然而，面對新的歷史條件下的各種矛盾，對于反思與糾正上海信訪工作中的種種弊端及缺陷，建立公眾參與和投訴的有效渠道，從而構(gòu)建新形勢下的社會秩序，使信訪工作適應國家和社會發(fā)展的需要顯得尤為重要。 本文試從信訪的概念、特征、類型入手，在分析信訪工作機制的歷史背景、人文原因和實際效果的基礎上，研究新的歷史條件下，上海信訪工作的現(xiàn)實困境，針對信訪現(xiàn)有的功能特點，建立信訪工作變革的評價標準。 同時，針對我國其他地區(qū)面對信訪工作困境而采取的新工作方式和方法，分析各個方式的長處和不足，對其進行系統(tǒng)的理論評價。借此對信訪工作的理念、設計進行一定的變革，構(gòu)建黨群、行政、司法和其它社會組織分類管理模式的信訪工作新機制。通過對信訪工作的變革，摒棄信訪制度中與我國政治制度、經(jīng)濟制度、法律制度、社會制度、文化制度不相適應的部分，逐步建立能適應新形勢下國家和社會發(fā)展的需要的工作方法和機制。通過信訪工作機制分類模式的構(gòu)建，建立公眾參與和投訴的有效渠道，理順公民權(quán)利救濟的路徑，最終實現(xiàn)有效的公共治理。
[Abstract]:With the deepening of reform, China is in a social transition period. Under the condition of unbalanced political, economic, social and cultural development, all kinds of contradictions appear day by day. Shanghai, as China's economic, financial, trade and shipping center, plays a vital role in the reform and opening up. In the face of the new historical conditions, new problems, new contradictions, letters and visits work in the face of excessive expectations and numerous contradictions, showing the development requirements of the times do not adapt, encountered unprecedented embarrassment and crisis. People from all walks of life continue to cause controversy on the work of letters and visits. At present, the emergence and existence of letters and visits have a certain historical background. The work of letters and visits has played a more active role in listening to the voices of people from all walks of life and in realizing social fairness and justice in a certain period and to a certain extent. Its existence has certain rationality. However, in the face of various contradictions under the new historical conditions, to reflect on and correct the shortcomings and defects in the work of letters and visits in Shanghai, to establish an effective channel for public participation and complaints, and thus to construct the social order under the new situation. It is particularly important to make the petition work adapt to the needs of national and social development. Based on the analysis of the historical background, humanistic reasons and practical effects of the petition work mechanism, this paper tries to study the practical predicament of the petition work in Shanghai under the new historical conditions. According to the existing functional characteristics of letters and visits, the evaluation criteria for the reform of letters and visits are established. At the same time, in view of the new working methods and methods adopted by other regions in China in the face of the plight of letters and visits, the advantages and disadvantages of each way are analyzed, and the systematic theoretical evaluation is carried out. Based on the concept of letter and visit work, this paper designs a new mechanism for the classified management of party and masses, administration, judicature and other social organizations. Through the reform of the work of letters and visits, we should abandon the parts of the petition system that are incompatible with the political system, the economic system, the legal system, the social system and the cultural system of our country. Gradually establish working methods and mechanisms that can meet the needs of national and social development under the new situation. Through the construction of the classified mode of the work mechanism of letters and visits, the effective channels of public participation and complaints should be established, and the path of civil rights relief should be straightened out, and finally effective public governance would be realized.
