【摘要】：當今世界正以不可逆轉之勢步入老齡化社會，老齡化問題倍受關注。1999年，我國進入老齡化社會，加速發(fā)展的老齡化給我國的政治、經(jīng)濟以及社會生活帶來了廣泛而深遠的影響。在未富先老的國情下，加強老年人的財產(chǎn)權益保護，成為我國應對老齡化社會的第一要務。鑒于老年人隨著年齡的增長，記憶力、判斷力逐漸衰退，行動遲緩的特點，將老年人的財產(chǎn)權益保護問題放在監(jiān)護制度的大框架下予以研究，將為該問題的解決提供新的思路。本文立足于我國的監(jiān)護制度改革，借鑒各國立法經(jīng)驗，完善老年人監(jiān)護制度的同時，在其框架下，設立獨立的老年人財產(chǎn)保護制度。本文主要圍繞監(jiān)護制度下老年人財產(chǎn)保護問題將文章分為三個部分： 第一章，老年人財產(chǎn)保護制度的社會價值與現(xiàn)狀。本章首先從人口背景和現(xiàn)實需求兩個方面闡述健全我國老年人財產(chǎn)保護制度的必要性。其次，剖析現(xiàn)行監(jiān)護制度立法的滯后性與局限性，表明立法與社會需求的脫節(jié)，突出監(jiān)護制度改革的迫切性。 第二章，老年人財產(chǎn)保護的特殊性。本章從老年人財產(chǎn)保護與未成年人、精神病人的財產(chǎn)保護的不同點著手，突出在監(jiān)護制度下，單獨設立老年人財產(chǎn)保護制度的必要性與可行性。 第三章，老年人財產(chǎn)保護制度的構建。本章從老年人財產(chǎn)保護制度的適用對象、保護人資格、職責等方面著手，，創(chuàng)設老年人意定監(jiān)護制度，加強對監(jiān)護人的監(jiān)督，在構建老年人監(jiān)護體系同時，建立獨立的老年人財產(chǎn)保護制度。
[Abstract]:Nowadays, the world is stepping into an aging society with the trend of irreversibility, and the problem of aging has attracted much attention. In 1999, when China entered the aging society, the accelerated aging of the society has brought extensive and far-reaching influence to the political, economic and social life of our country. Strengthening the protection of the property rights and interests of the elderly before becoming rich becomes the first priority of our country to deal with the aging society. In view of the characteristics of aging, memory, judgment and slowness of action, the study on the protection of the property rights and interests of the elderly under the framework of the guardianship system will provide a new way of thinking for the solution of this problem. Based on the reform of the guardianship system in our country, this paper draws lessons from the legislative experience of various countries and improves the guardianship system for the elderly. At the same time, under the framework of the system, an independent system for the protection of the property of the elderly is established. The article is divided into three parts: chapter one, the social value and present situation of the property protection system of the elderly. This chapter firstly expounds the necessity of perfecting the property protection system of the elderly in our country from the two aspects of population background and realistic demand. Secondly, the author analyzes the lag and limitation of the current guardianship system legislation, which shows the disconnection between the legislation and the social needs, and highlights the urgency of the reform of the guardianship system. The second chapter, the particularity of the old people's property protection. This chapter starts with the differences between the property protection of the elderly and the minors and the mental patients, and emphasizes the necessity and feasibility of setting up the property protection system of the elderly alone under the guardianship system. The third chapter, the old people property protection system construction. This chapter starts from the suitable object of the old people's property protection system, the protector's qualification, the duty and so on, establishes the old person's determined guardianship system, strengthens the supervision to the guardian, constructs the old person's guardianship system at the same time, To establish an independent system for the protection of the property of the elderly.
