【摘要】：習(xí)近平總書記在黨的十八屆四中全會中指出"堅持依法治國首先要堅持依憲治國,堅持依法執(zhí)政首先要堅持依憲執(zhí)政。"這句話強調(diào)了憲法地位的威嚴性和實施的重要性。憲法是國家的根本大法,依憲治國是依法治國的依據(jù)和前提,只有依照憲法管理國家的事務(wù),才能為有序、穩(wěn)定的發(fā)展創(chuàng)造良好的法律環(huán)境,保障人民權(quán)利實現(xiàn)。本文在資料分析和實踐調(diào)查的基礎(chǔ)上,對習(xí)近平依憲治國思想的相關(guān)概念與理論基礎(chǔ)、習(xí)近平依憲治國思想的主要內(nèi)容與基本特征、習(xí)近平依憲治國思想的時代價值等方面對習(xí)近平依憲治國思想進行嘗試性的研究。在上述諸方面中,習(xí)近平依憲治國思想的主要內(nèi)容與基本特征及時代價值是本文的重點。文章從依法治國、黨的執(zhí)政方法、行政體制改革、制度體制改革、司法公正等方面闡述了習(xí)近平依憲治國思想的內(nèi)容,并從政治、經(jīng)濟、理論、政權(quán)等角度明確了習(xí)近平依憲治國思想的基本特征。習(xí)近平依憲治國思想是在我國社會主義法治建設(shè)的實踐中總結(jié)出來的,具有豐富的理論價值,是黨依法執(zhí)政的需要;是改革治理的需要;是凝聚共識的需要。同時依憲治國思想還彰顯著時代的意義,有利于為全面推進依法治國奠定堅實基礎(chǔ);有利于完善中國特色社會主義法律體系;有利于保證黨對推進依法治國的領(lǐng)導(dǎo)。
[Abstract]:General Secretary Xi Jinping pointed out in the fourth Plenary session of the 18th CPC Central Committee that "to uphold the rule of law, we must first adhere to the rule of law, adhere to the rule of law must first adhere to the rule of law." This sentence emphasizes the majesty of the constitutional status and the importance of its implementation. The constitution is the fundamental law of the country and governing the country according to the constitution is the basis and premise of governing the country according to law. Only by administering the affairs of the country according to the constitution can we create a good legal environment for the orderly and stable development and guarantee the realization of the people's rights. On the basis of data analysis and practical investigation, this paper analyzes the related concepts and theoretical basis of Xi Jinping's thought of governing the country according to the Constitution, and the main contents and basic characteristics of the thought of "ruling the country according to the Constitution" by Xi Jinping. Xi Jinping's thought of governing the country according to the Constitution, such as the value of the times, and so on, has carried on the tentative research to the thought of running the country according to the constitution. Among the above aspects, the main content and basic characteristics of Xi Jinping's thought of governing the country according to the Constitution and the value of the times are the emphases of this paper. This paper expounds the content of Xi Jinping's thought of governing the country according to the Constitution from the aspects of ruling the country according to law, the ruling method of the Party, the reform of the administrative system, the reform of the system and the justice of justice, and expounds the political, economic, and theoretical aspects. Political power and other angles clarified the basic characteristics of Xi Jinping's thought of governing the country in accordance with the Constitution. Xi Jinping's thought of governing the country in accordance with the Constitution is summed up in the practice of the construction of socialist rule of law in our country, which has rich theoretical value, is the need of the Party to govern according to law, is the need of reform and governance, and is the need to gather consensus. At the same time, the thought of governing the country according to the constitution also shows the significance of the times, which is conducive to laying a solid foundation for promoting the rule of law in an all-round way, to perfecting the socialist legal system with Chinese characteristics, and to ensuring the Party's leadership in promoting the rule of law.
