【摘要】：關(guān)注弱勢(shì)群體是現(xiàn)代文明社會(huì)共同的價(jià)值追求。由于受生理、心理和觀念等特殊因素的影響,并在各種新的風(fēng)險(xiǎn)如城鎮(zhèn)化、全球化的沖擊下,老年人日益成為社會(huì)弱勢(shì)群體�，F(xiàn)實(shí)中,他們往往在政治、經(jīng)濟(jì)和社會(huì)生活等領(lǐng)域,遭受著被排擠、漠視甚至虐待等不平等的待遇,這些都將導(dǎo)致他們實(shí)體權(quán)利的不公正。不可否認(rèn),我國(guó)老年人曾經(jīng)為子女的成長(zhǎng)、社會(huì)發(fā)展和國(guó)家建設(shè)作出了巨大的貢獻(xiàn),因而,在他們年老時(shí),理應(yīng)受到國(guó)家、社會(huì)和晚輩的普遍尊重與愛護(hù)。近年來,隨著我國(guó)法制建設(shè)的進(jìn)步與發(fā)展,尤其是《老年人權(quán)益保障法》(以下簡(jiǎn)稱《老年法》)的制定和實(shí)施,明確規(guī)定了老年人所享有的特殊權(quán)益,重新定義了老年人的法律地位和社會(huì)價(jià)值,使得老年群體不再被冷落和邊緣化。關(guān)心老年人的生存與發(fā)展,尊重其人格與自由,切實(shí)維護(hù)老年人合法權(quán)益,應(yīng)當(dāng)說,我國(guó)《老年法》愈發(fā)彰顯著豐富的人文關(guān)懷思想。本文從我國(guó)《老年法》的現(xiàn)狀出發(fā),深入挖掘其潛在的人文關(guān)懷理念,分析其存在的問題,并從法律角度探求加強(qiáng)《老年法》人文關(guān)懷的路徑。論文共分為五個(gè)部分,主要內(nèi)容如下:第一部分主要介紹了文章的選題背景與意義、研究思路和研究方法,梳理并評(píng)述了目前國(guó)內(nèi)外學(xué)術(shù)界相關(guān)研究成果,指出了本文可能的創(chuàng)新之處與不足。第二部分較為全面地論述了本文的理論基礎(chǔ),即主要從馬克思主義人文關(guān)懷思想的理論來源出發(fā),闡釋了其基本內(nèi)涵,進(jìn)而提出馬克思人文關(guān)懷思想的指導(dǎo)價(jià)值。第三部分在梳理和考察國(guó)內(nèi)外老年法律制度的發(fā)展現(xiàn)狀的基礎(chǔ)上,闡述了我國(guó)新《老年法》中所蘊(yùn)涵的人文關(guān)懷思想,即樹立權(quán)利本位的價(jià)值理念,積極應(yīng)對(duì)老齡化、逐步重視老年人的價(jià)值,滿足老年人多方面的需要、開始注重精神慰藉,充滿人性化的制度設(shè)計(jì)。第四部分分析和研究了我國(guó)《老年法》的相關(guān)規(guī)定和實(shí)踐情況,從而指出了現(xiàn)有的許多法律人文關(guān)懷缺失問題,并進(jìn)行了相關(guān)原因分析。第五部分主要從堅(jiān)持以人為本的立法理念和具體制度設(shè)計(jì)兩個(gè)層面探索加強(qiáng)我國(guó)《老年法》人文關(guān)懷的路徑。
[Abstract]:Attention to vulnerable groups is the common value pursuit of modern civil society. Due to the influence of special factors, such as physiology, psychology and ideas, and under the impact of various new risks such as urbanization and globalization, Older people are increasingly becoming vulnerable groups in society. In reality, they are often subjected to unequal treatment, such as exclusion, neglect and even abuse, in political, economic and social life. These will lead to the injustice of their substantive rights... It is undeniable that our elderly have made great contributions to the growth of their children, social development and nation-building, and therefore, in their old age, deserve the State, In recent years, with the progress and development of the legal system in our country, especially the enactment and implementation of the Law on the Protection of the Rights and interests of the elderly (hereinafter referred to as "the Law of the elderly"), Having clearly defined the special rights and interests enjoyed by older persons, redefining their legal status and social values so that older groups are no longer left out and marginalized... caring for the survival and development of older persons and respecting their personality and freedom, In order to safeguard the legal rights and interests of the elderly, we should say that the Law of the elderly in our country is showing more and more rich thoughts of humanistic solicitude. This paper, proceeding from the present situation of the Law of the aged in our country, deeply excavates its potential humanistic care idea. The thesis is divided into five parts. The main contents are as follows: the first part mainly introduces the background and significance of the article. In the second part, the theoretical basis of this paper is discussed comprehensively, and the research ideas and methods are summarized and reviewed, and the possible innovations and shortcomings of this paper are pointed out. That is, mainly from the theoretical source of Marxist humanistic care thought, it explains its basic connotation. Then it puts forward the guiding value of Marx's humanistic solicitude. The third part, on the basis of combing and investigating the current situation of the development of the old age legal system at home and abroad, expounds the humanistic solicitude thought contained in the new Old Age Law of our country. That is, to set up the value concept of the right standard, to deal with the aging actively, to pay attention to the value of the elderly step by step, to meet the needs of many aspects of the elderly, and to begin to pay attention to the spiritual comfort. Part 4th analyzes and studies the relevant provisions and practice of the Old Age Law in China, and points out the lack of humanistic care in many existing laws. Part 5th mainly explores the ways to strengthen the humanistic care of "the Law of the aged" from the two aspects of adhering to the people-oriented legislative concept and the specific system design.
