【摘要】：近年來,跨境代孕親子關系認定糾紛逐漸增多的問題,已引起了海牙國際私法會議的高度重視。海牙國際私法會議也已向成員國發(fā)出了共同協(xié)商制定一部有關跨境代孕親子關系認定公約的呼吁。跨境代孕親子關系的認定問題本身會受到一國國內(nèi)政治、經(jīng)濟、文化、宗教信仰等因素的影響,加之各國對其所作的法律規(guī)定又不盡相同,極易導致法律沖突現(xiàn)象的產(chǎn)生,故而亦給國際私法學界提出了一個嶄新課題。當前世界上的一些主要國家在解決跨境代孕親子關系的認定問題上,傾向于適用委托父母的本國法。外國代孕子女身份認定的承認,常被承認地國以違反公共秩序為由而予以拒絕。我國目前沒有相關跨境代孕親子關系認定的立法,但中國籍父母出境尋求代孕服務的情況卻時有發(fā)生,有必要就跨境代孕親子關系的認定問題提進一步完善立法。
[Abstract]:In recent years, the issue of cross-border parent-child relationship identification disputes has gradually increased. The Hague Conference on Private International Law has also issued a call for member States to work out a convention on the identification of cross-border surrogacy. Determining that the problem itself would be subject to the domestic politics of a country, The influence of economy, culture, religious belief and other factors, together with the different laws and regulations made by different countries, can easily lead to the phenomenon of conflict of laws. As a result, a new topic has been put forward to the field of private international law. At present, some major countries in the world are trying to solve the problem of determining cross-border surrogate parent-child relations. The recognition of the identity of a surrogate child in a foreign country is often rejected by the country where it is recognized because it is contrary to public order. At present, China has no relevant legislation on the identification of the cross-border surrogate parent-child relationship. However, the situation that Chinese parents leave the country to seek surrogacy services occurs from time to time, so it is necessary to put forward further legislation on the identification of cross-border surrogate parent-child relationship.
