【摘要】：當(dāng)前,我國(guó)在政治、經(jīng)濟(jì)、社會(huì)等方面取得了偉大成就,同時(shí)也面臨著一系列的矛盾和挑戰(zhàn),突發(fā)公共事件日益增多就是一個(gè)必須重視的問(wèn)題。在突發(fā)公共事件中,政府信息公開(kāi)的成功與否關(guān)系到事件處置的成功與否,關(guān)系社會(huì)治理能力和治理體系現(xiàn)代化。然而,在現(xiàn)實(shí)中我們看到,有的政府為了維護(hù)當(dāng)前穩(wěn)定大局,采用簡(jiǎn)單粗暴的手法實(shí)行高壓式的“維穩(wěn)”,而不是積極應(yīng)對(duì),其結(jié)果往往是揚(yáng)湯止沸,甚至火上加油,達(dá)不到預(yù)期效果,石首事件就是一個(gè)例子。解決突發(fā)公共事件的根本還在于追根溯源,實(shí)現(xiàn)政府信息公開(kāi),保障公民的知情權(quán)。深刻理解突發(fā)公共事件與政府信息公開(kāi)密不可分的內(nèi)在聯(lián)系,建構(gòu)起有效的、完善的政府信息公開(kāi)機(jī)制,才是應(yīng)對(duì)突發(fā)公共事件的長(zhǎng)效機(jī)制。因此,本文試從突發(fā)公共事件中政府信息公開(kāi)的機(jī)制完善入手,首先認(rèn)識(shí)突發(fā)公共事件與政府信息公開(kāi)的內(nèi)涵與意義,進(jìn)而分析突發(fā)公共事件與政府信息公開(kāi)的內(nèi)在聯(lián)系,強(qiáng)調(diào)政府信息公開(kāi)是應(yīng)對(duì)突發(fā)公共事件的核心環(huán)節(jié)。其次,在闡明突發(fā)公共事件中政府信息公開(kāi)的體系結(jié)構(gòu)的基礎(chǔ)上,圍繞其主體機(jī)制、內(nèi)容機(jī)制、法律機(jī)制、監(jiān)督機(jī)制、救濟(jì)機(jī)制、配套機(jī)制展開(kāi)敘述。再次,通過(guò)觀(guān)察現(xiàn)實(shí)對(duì)中國(guó)社會(huì)不穩(wěn)定的原因進(jìn)行分析,主要從縱向和橫向上對(duì)我國(guó)政府信息公開(kāi)現(xiàn)狀進(jìn)行分析,在縱向上,分析改革開(kāi)放以來(lái)我國(guó)在突發(fā)公共事件中政府信息公開(kāi)的發(fā)展歷史;在橫向上,分析突發(fā)公共事件中政府信息公開(kāi)的主體、內(nèi)容、法律、監(jiān)督、救濟(jì)、配套機(jī)制的發(fā)展。同時(shí)借鑒國(guó)外在理論基礎(chǔ)、基本原則、立法層次、對(duì)象范圍上的相關(guān)經(jīng)驗(yàn),隨后,提出完善我國(guó)突發(fā)公共事件中政府信息公開(kāi)機(jī)制的建議,認(rèn)為應(yīng)從信息公開(kāi)的義務(wù)主體和權(quán)利主體的范圍選擇上完善主體機(jī)制;在內(nèi)容機(jī)制上明確應(yīng)主動(dòng)公開(kāi)的政府信息、依申請(qǐng)公開(kāi)的政府信息、限制公開(kāi)的政府信息、不予公開(kāi)的政府信息;在法律機(jī)制上,應(yīng)該提高政府信息公開(kāi)的立法層次、明確政府信息公開(kāi)的程序規(guī)定、提高政府信息公開(kāi)意識(shí)和公開(kāi)水平;從內(nèi)部監(jiān)督機(jī)制、專(zhuān)門(mén)機(jī)構(gòu)監(jiān)督機(jī)制、媒體與人民監(jiān)督機(jī)制上完善監(jiān)督機(jī)制;結(jié)合行政復(fù)議和行政訴訟機(jī)制完善救濟(jì)機(jī)制;在發(fā)展保密機(jī)制和檔案管理機(jī)制的基礎(chǔ)上完善配套機(jī)制。當(dāng)前,我們?yōu)閷?shí)現(xiàn)中華民族偉大復(fù)興的中國(guó)夢(mèng)而努力,而順利解決突發(fā)公共事件,完善其中的政府信息公開(kāi)機(jī)制為中國(guó)夢(mèng)的順利實(shí)現(xiàn)提供制度保障。
[Abstract]:At present, China has made great achievements in politics, economy, society and so on. At the same time, it is also facing a series of contradictions and challenges. The increasing number of public emergencies is a problem that must be paid attention to. The success of the disclosure of government information is related to the success or failure of the handling of the incident, the ability of social governance and the modernization of the governance system. However, in reality, we see that some governments, in order to maintain the overall situation of current stability, The use of simple and crude techniques to implement high-pressure "stability" rather than positive response, the result is often Yang Tang to stop boiling, or even add fuel to the fire, can not achieve the desired results, The Shishou incident is an example. The fundamental solution to a public emergency is to trace it back to the source, to realize the disclosure of government information, and to protect the citizens' right to know. To construct an effective and perfect mechanism of government information disclosure is the long-term mechanism to deal with public emergencies. Therefore, this paper tries to improve the mechanism of government information disclosure in public emergencies. First of all, we understand the connotation and significance of public emergencies and government information disclosure, and then analyze the internal relationship between public emergencies and government information disclosure, and emphasize that the disclosure of government information is the core link to deal with public emergencies. Secondly, On the basis of expounding the system structure of government information disclosure in public emergencies, this paper focuses on its main mechanism, content mechanism, legal mechanism, supervision mechanism, relief mechanism and supporting mechanism. By observing the reality, the causes of social instability in China are analyzed, and the present situation of government information disclosure in China is analyzed both vertically and horizontally. This paper analyzes the development history of government information disclosure in public emergencies in China since the reform and opening up; horizontally, analyzes the subject, content, law, supervision and relief of government information disclosure in public emergencies. At the same time, draw lessons from the relevant experience of foreign countries in the theoretical basis, basic principles, legislative levels, object scope, and then, put forward suggestions to improve the mechanism of government information disclosure in public emergencies in China. The author thinks that the main body mechanism should be perfected from the scope selection of the subject of obligation and the subject of right, and the government information should be made public on the content mechanism, the government information should be opened according to the application, and the open government information should be restricted. In the legal mechanism, we should raise the legislative level of government information disclosure, clarify the procedural provisions of government information disclosure, improve the awareness and level of government information disclosure, and improve the internal supervision mechanism. The supervision mechanism of the specialized agencies, the supervision mechanism of the media and the people, the improvement of the relief mechanism combined with the mechanism of administrative reconsideration and administrative litigation, the improvement of the supporting mechanism on the basis of the development of the mechanism of confidentiality and the mechanism of archives management. At present, We make great efforts to realize Chinese Dream, the great rejuvenation of the Chinese nation, and solve public emergencies smoothly, and perfect the mechanism of government information disclosure to provide system guarantee for the smooth realization of Chinese Dream.
