【摘要】：改革開(kāi)放以來(lái)，隨著經(jīng)濟(jì)體制多元化的調(diào)整，以私營(yíng)企業(yè)為主的非公有制經(jīng)濟(jì)所占的比重越來(lái)越大，成為國(guó)民經(jīng)濟(jì)中的重要組成部分非公有制企業(yè)在經(jīng)濟(jì)中所占比重不斷加大但是由此帶來(lái)的非公有制企業(yè)勞資矛盾的問(wèn)題也越來(lái)越突出工會(huì)作為解決勞資矛盾的有效主體，成為非公企業(yè)建設(shè)的重要部分但是，，由于非公企業(yè)工會(huì)建設(shè)水平不高，運(yùn)行存在多方面問(wèn)題，難以發(fā)揮工會(huì)的作用，導(dǎo)致工人合法權(quán)益難以維護(hù)勞資矛盾激化等問(wèn)題因此，加強(qiáng)非公企業(yè)工會(huì)組建和運(yùn)行工作，推進(jìn)非公企業(yè)工會(huì)職能實(shí)現(xiàn)，維護(hù)工人合法權(quán)益，實(shí)現(xiàn)勞資關(guān)系和諧，是工會(huì)黨委和政府等各方面臨的重要問(wèn)題 本文首先界定了企業(yè)非公企業(yè)工會(huì)等相關(guān)研究概念，以工會(huì)理論勞資關(guān)系理論和法團(tuán)理論為研究基礎(chǔ)理論，描述了市場(chǎng)經(jīng)濟(jì)體制下非公有制企業(yè)勞資關(guān)系和工會(huì)運(yùn)行現(xiàn)狀并從勞方和資方等微觀因素及政治經(jīng)濟(jì)文化法律等宏觀因素方面進(jìn)行了分析，在分析工會(huì)的組織特點(diǎn)非公企業(yè)勞資關(guān)系工會(huì)的職能地位權(quán)利和義務(wù)的基礎(chǔ)上，提出了非公企業(yè)工會(huì)職能實(shí)現(xiàn)保障體系模型，最后總結(jié)并提出了非公企業(yè)的組建和運(yùn)行保障機(jī)制建設(shè)的基本方案，以期為非公企業(yè)建設(shè)提供借鑒性意見(jiàn)
[Abstract]:Since the reform and opening up, with the adjustment of the diversified economic system, the proportion of non-public economy dominated by private enterprises is increasing. As an important part of the national economy, the proportion of non-public-owned enterprises in the economy is increasing, but the problems of labor-capital contradictions in non-public-owned enterprises are becoming more and more prominent. The main body. As an important part of the construction of non-public enterprises, it is difficult to give full play to the role of trade unions because of the low level of trade union construction in non-public enterprises and the existence of many problems in operation. As a result, it is difficult to maintain the legitimate rights and interests of workers. Therefore, it is necessary to strengthen the formation and operation of trade unions in non-public enterprises, promote the realization of the functions of trade unions in non-public enterprises, and safeguard the legitimate rights and interests of workers. Realizing the harmonious relationship between Labor and Capital is an important problem faced by the Party Committee and the Government of the Trade Union This paper first defines the related research concepts such as non-public enterprise trade union and so on, taking the labor union theory and the corporation theory as the basic theories. This paper describes the present situation of labor relations and trade unions in non-public enterprises under the market economy system, and analyzes the microcosmic factors such as labor and management, political, economic, cultural, legal and other macro factors. On the basis of analyzing the organizational characteristics of trade unions, the rights and obligations of the functional status of labor relations trade unions in non-public enterprises, this paper puts forward a model of functional security system for trade unions in non-public enterprises. In the end, the paper summarizes and puts forward the basic scheme of the establishment and operation guarantee mechanism of non-public enterprises, in order to provide reference opinions for the construction of non-public enterprises.
