【摘要】：隨著互聯(lián)網(wǎng)的快速發(fā)展,人們的生活已經(jīng)離不開網(wǎng)絡,網(wǎng)吧在極大地滿足人們上網(wǎng)需求的同時,也極大地豐富了人們的精神生活。但近年來隨著網(wǎng)吧經(jīng)營實行許可制度,國家嚴格控制后,網(wǎng)吧產(chǎn)業(yè)發(fā)展出現(xiàn)了不平衡,黑網(wǎng)吧開始涌現(xiàn)和蔓延,社會危害之劇烈,已經(jīng)引起廣泛關注。作為浙江省經(jīng)濟首富的X區(qū),黑網(wǎng)吧問題就十分突出和典型,成為了引發(fā)投訴和群眾矛盾的焦點。為此,2009年X區(qū)成立由工商、公安、文化等部門聯(lián)合的黑網(wǎng)吧綜合整治小組全面治理黑網(wǎng)吧,而今距離領導小組成立也已近有好幾個年頭,但現(xiàn)實的治理效果并不顯著,黑網(wǎng)吧仍舊禁而不止、查而不絕,對該區(qū)政治、經(jīng)濟、文化發(fā)展產(chǎn)生巨大威脅,因此有必要對X區(qū)的黑網(wǎng)吧綜合治理再進行探討,特別是對綜合治理過程中的政策執(zhí)行進行調(diào)整顯得刻不容緩。 通過問卷調(diào)查、個人訪談、數(shù)據(jù)查詢等方法調(diào)查X區(qū)黑網(wǎng)吧現(xiàn)狀,在全面概括總結的基礎上,了解其特征為數(shù)量眾多并且難發(fā)現(xiàn)、城郊結合部及農(nóng)村問題突出、網(wǎng)吧經(jīng)營者及消費群體情況復雜,分析其危害主要為安全隱患突出、影響未成年人成長、網(wǎng)絡信息內(nèi)容缺乏監(jiān)管、影響社會治安和穩(wěn)定,深挖其成因為行政權設定錯誤、監(jiān)管職責錯位、性質(zhì)定位不準、社會矛盾綜合交織。進而對X區(qū)黑網(wǎng)吧綜合治理政策執(zhí)行中的主體、分工、監(jiān)控、策略選擇、資源分配與調(diào)整、利益分享進行詳細分析,由此明確黑網(wǎng)吧綜合治理領導小組為執(zhí)行主體負責工作的展開推進,工商部門作為牽頭單位肩負黑網(wǎng)吧的監(jiān)管工作,文化、公安、鎮(zhèn)街、網(wǎng)絡運營商等單位相互合作,區(qū)委區(qū)政府監(jiān)督控制治理工作,黑網(wǎng)吧領導小組按照屬地管理、部門聯(lián)動的原則由柔到剛推行執(zhí)行策略,充分運用財力、物力、人力、信息和制度資源,達到執(zhí)行利益共享的目的。在此執(zhí)行分析的基礎上,采用公共政策評估手段得出評估結論,即運行機制缺乏全面的權衡、分工不足、合作有余、定性與定量監(jiān)控結合不夠、對待執(zhí)行資源利用不合理、執(zhí)行策略缺乏適時適地適合。在整體政府的視角,因地制宜地提出X區(qū)黑網(wǎng)吧綜合治理政策執(zhí)行的調(diào)整建議,即從重新構建黑網(wǎng)吧綜合治理組織結構、強勢整治結合嚴厲查處、加強網(wǎng)絡運營商責任落實來規(guī)范運行機制,從加強宣傳力度和輿論正面引導的文化建設、發(fā)動社會力量建立健全的線索舉報制度、加強對干部管理、完善信用評估機制、發(fā)揮行業(yè)協(xié)會作用來加強執(zhí)行監(jiān)控,從重需求、降門檻、有序規(guī)劃與合理布局、創(chuàng)新手段實現(xiàn)分類監(jiān)管來合理利用政策資源,從普及網(wǎng)絡豐富公共文化、加強對特殊弱勢群體的關心幫助來提高公共服務能力。
[Abstract]:With the rapid development of the Internet, people's lives have been inseparable from the network, Internet cafes in the great satisfaction of people's needs on the Internet at the same time. Also greatly enriched people's spiritual life. But in recent years, with the implementation of the licensing system of Internet cafes, the development of the Internet cafes industry has appeared imbalance, black Internet cafes began to emerge and spread. As the richest area in Zhejiang Province, the problem of black Internet cafes is very prominent and typical, which has become the focus of complaints and mass contradictions. In 2009, area X was set up by the industry and commerce, public security, culture and other departments of the black Internet cafes comprehensive rectification team comprehensive governance of black Internet cafes, and now it has been several years since the establishment of the leading group. However, the actual effect of governance is not significant, black Internet cafes are still prohibited, and continue to investigate, to the political, economic and cultural development of the region has a huge threat, so it is necessary to explore the comprehensive management of black Internet cafes in area X. In particular, it is urgent to adjust the policy implementation in the process of comprehensive management. Through questionnaire, personal interviews, data query and other methods to investigate the current situation of black Internet cafes in area X, on the basis of a comprehensive summary, understand its characteristics are numerous and difficult to find. Suburban junction and rural problems are prominent, the situation of Internet cafe operators and consumer groups is complex, the main hazards are the prominent security hazards, affecting the growth of minors, lack of supervision of the content of network information. Affect social security and stability, dig deep because of administrative power set wrong, supervision and responsibility misplaced, the nature of positioning, social contradictions comprehensive intertwined, and then on the X area black Internet cafes comprehensive management policy implementation of the main body. Division of labor, monitoring, strategy selection, resource allocation and adjustment, benefit sharing detailed analysis, so as to make clear that the black Internet bar comprehensive management leading group for the implementation of the main body responsible for the development of the work. Industrial and commercial departments as the lead unit shoulders the supervision work of black Internet bar, culture, public security, town street, network operator and other units cooperate with each other, the district committee and district government supervises and controls the management work. Black Internet Cafe leading group according to the territorial management, the principle of departmental linkage from flexibility to the implementation of the implementation strategy, the full use of financial, material, human, information and institutional resources. On the basis of the analysis of implementation, we use the public policy evaluation method to get the evaluation conclusion, that is, the operational mechanism is lack of comprehensive trade-off, the division of labor is insufficient, and there is more than cooperation. The combination of qualitative and quantitative monitoring is not enough, the use of implementation resources is unreasonable, and the implementation strategy is not suitable for the whole government. According to local conditions put forward the X area black Internet cafes comprehensive management policy implementation adjustment suggestions, that is, from the re-construction of black Internet cafes comprehensive governance organization structure, strong regulation combined with strict investigation and punishment. Strengthen the responsibility of network operators to standardize the operation mechanism, from the strengthening of propaganda and public opinion positive guidance of cultural construction, mobilize social forces to establish a sound clue reporting system, and strengthen the management of cadres. Improve the credit evaluation mechanism, give play to the role of industry associations to strengthen the implementation of monitoring, from the demand, reduce the threshold, orderly planning and rational layout, innovative means to achieve classification supervision to make rational use of policy resources. From popularizing the network to enrich the public culture and strengthen the care and help to the special vulnerable groups to improve the public service capacity.
