【摘要】：近代以來,家族財(cái)產(chǎn)繼承方式與工商企業(yè)關(guān)系的論述存在明顯空間差異。傳統(tǒng)以集中繼承為主的西方,理論和實(shí)踐卻均傾向于分散繼承;傳統(tǒng)以分散繼承制為典型的中國,理論界卻對分散繼承更多持否定態(tài)度。對近代以來中外工商業(yè)家族財(cái)產(chǎn)繼承史實(shí)的梳理發(fā)現(xiàn),工商業(yè)家族普遍傾向于分散繼承。因此,就分散繼承與工商企業(yè)發(fā)展持消極態(tài)度的傳統(tǒng)觀點(diǎn)值得進(jìn)一步商榷。
[Abstract]:Since modern times, there are obvious spatial differences between the way of inheritance of family property and the relationship between industrial and commercial enterprises. The tradition of concentrated inheritance is mainly in the west, but both theory and practice tend to be decentralized inheritance, while in China, which is typical of decentralized inheritance system, the theoretical circle holds a negative attitude towards decentralized inheritance. It is found that the family of industry and commerce generally tends to inherit in a scattered way by combing the historical facts of inheritance of Chinese and foreign industrial and commercial family property since modern times. Therefore, the traditional view of negative attitude towards decentralization and the development of industrial and commercial enterprises deserves further discussion.
