【摘要】：通過分析清末山會(huì)商務(wù)分會(huì)的"理案"材料,可以發(fā)現(xiàn)相當(dāng)比例的案件并不是商會(huì)獨(dú)立理處的,官權(quán)多多少少地介入其間。官員通過"官批商辦"的形式,借助商會(huì)的理案職能去處理糾紛,增強(qiáng)了官權(quán)對商民群體的滲透能力。此外,得益于商會(huì)的"牒官權(quán)",商民可以通過商會(huì)與官員聯(lián)系,從而打破書差對商民與官員的溝通渠道的壟斷,在一定程度上削弱了差役的權(quán)力,使官權(quán)可以更順暢地向商民群體滲透。而商會(huì)則通過"牒官權(quán)"引官權(quán)自重,狐假虎威地借助官員的權(quán)威,增強(qiáng)自身的權(quán)力。官員與商會(huì)的權(quán)力,在"理案"過程中,相互配合,共進(jìn)共強(qiáng)。
[Abstract]:By analyzing the "case management" materials of Shanhui Business Branch in the late Qing Dynasty, it can be found that a considerable proportion of cases are not handled independently by the Chamber of Commerce, and officials and authorities are more or less involved in the case. In the form of "official approval of business office", officials handled disputes with the help of the Chamber of Commerce's case handling function, which enhanced the ability of the official power to infiltrate the group of businessmen and the people. In addition, thanks to the "ultimatum power" of the Chamber of Commerce, the business people can contact officials through the Chamber of Commerce, thus breaking the monopoly on the channels of communication between the merchants and the officials, thus weakening the power of the officers to a certain extent. So that the official power can be more smoothly infiltrated into the business community. And the Chamber of Commerce, through "ultimatum" to lead officials to respect themselves, using the authority of officials to strengthen their own power. The power of officials and chambers of commerce in the process of handling cases, mutual cooperation and common strength.
