【摘要】：國(guó)有企業(yè)和國(guó)家指定壟斷企業(yè)是TPP協(xié)議一個(gè)重要內(nèi)容,協(xié)議對(duì)這些企業(yè)的貿(mào)易和投資行為所做的規(guī)定在某種程度上參照了WTO規(guī)則,特別是TPP關(guān)于國(guó)營(yíng)貿(mào)易企業(yè)和壟斷性服務(wù)供應(yīng)商的規(guī)定以及關(guān)于政府補(bǔ)貼的規(guī)定,但在國(guó)有企業(yè)和指定壟斷企業(yè)的定義、政府補(bǔ)貼、國(guó)有企業(yè)投資、監(jiān)管中立、司法管轄、一般例外、國(guó)別例外和爭(zhēng)端解決等幾個(gè)方面,該協(xié)議的規(guī)定或是首創(chuàng),或是比WTO的規(guī)定更加具體和有針對(duì)性。作為迄今為止標(biāo)準(zhǔn)最高的區(qū)域自由貿(mào)易協(xié)議,TPP協(xié)議有關(guān)規(guī)定很可能成為將來(lái)區(qū)域自由貿(mào)易協(xié)議制定相關(guān)紀(jì)律,乃至WTO深化現(xiàn)行有關(guān)規(guī)定的參考。
[Abstract]:State-owned enterprises and state-designated monopoly enterprises are an important part of the TPP agreement, and the provisions of the agreement on the trade and investment behavior of these enterprises refer to the WTO rules to some extent. In particular, the TPP regulations on state-owned trading enterprises and monopoly service providers and on government subsidies, but in the definition of state-owned enterprises and designated monopoly enterprises, government subsidies, state-owned enterprises investment, regulatory neutrality, jurisdiction, General exceptions, country exceptions and dispute settlement, the provisions of the agreement are either the first, or more specific and targeted than the provisions of the WTO. As the highest standard regional free trade agreement (RFTA) so far, the relevant provisions of the RFTA are likely to be the reference for future regional free trade agreements to formulate relevant disciplines and even the WTO to deepen the existing relevant provisions.
