【摘要】：文章基于社會責(zé)任內(nèi)容的不同,將民營企業(yè)社會責(zé)任類型化為法律、經(jīng)濟(jì)和社會三個方面,并將社會責(zé)任的不同類型層次化為基本社會責(zé)任、必要社會責(zé)任和更高層次社會責(zé)任。通過對安徽省民營企業(yè)社會責(zé)任履行情況的實證研究,發(fā)現(xiàn)當(dāng)前安徽省民營企業(yè)履行社會責(zé)任存在主觀意愿因社會責(zé)任類型而不同、履行社會責(zé)任的客觀程度與社會責(zé)任層次呈負(fù)相關(guān)以及履行社會責(zé)任的效果與規(guī)范的約束力呈正相關(guān)等失衡和無序問題,其主要原因在于約束性規(guī)范的不力和促進(jìn)性規(guī)范的不暢。就法律規(guī)制而言,發(fā)揮強(qiáng)制性規(guī)范、任意性規(guī)范和促進(jìn)性規(guī)范對各類社會責(zé)任的約束和引導(dǎo),強(qiáng)化正式制度對民營企業(yè)履行社會責(zé)任的他律,實現(xiàn)民營企業(yè)履責(zé)的有序和協(xié)調(diào)。
[Abstract]:Based on the different content of social responsibility, this paper transforms the social responsibility of private enterprises into three aspects: law, economy and society, and the different types of social responsibility are transformed into basic social responsibility. Necessary social responsibility and higher level of social responsibility. Through the empirical study on the social responsibility performance of private enterprises in Anhui Province, it is found that the subjective will of private enterprises to fulfill social responsibility in Anhui Province is different according to the type of social responsibility. The objective degree of fulfilling social responsibility is negatively related to the level of social responsibility, and the effect of fulfilling social responsibility is positively related to the binding force of norms, such as imbalance and disorder. The main reason lies in the ineffectiveness of binding norms and the difficulty of promoting norms. As far as legal regulation is concerned, we should give full play to the constraint and guidance of compulsory, arbitrary and promotive norms on all kinds of social responsibilities, strengthen the rules of the formal system to fulfill social responsibility for private enterprises, and realize the order and coordination of the responsibilities of private enterprises.
