企業(yè)社會(huì)責(zé)任視角下的農(nóng)民工權(quán)益保障問(wèn)題研究

【摘要】:農(nóng)民工是我國(guó)二元戶籍制度的特殊產(chǎn)物,由于體制機(jī)制不健全以及農(nóng)民工自身文化水平有限等因素,農(nóng)民工權(quán)益一直處于缺失狀態(tài)。同時(shí),企業(yè)社會(huì)責(zé)任缺失也是造成農(nóng)民工權(quán)益受損的重要原因,自20世紀(jì)90年代企業(yè)社會(huì)責(zé)任傳入發(fā)展中國(guó)家以來(lái),對(duì)于以勞動(dòng)密集型企業(yè)為主的中國(guó)而言,勞工權(quán)益保護(hù)問(wèn)題已經(jīng)嚴(yán)重削弱了中國(guó)企業(yè)的國(guó)際競(jìng)爭(zhēng)力,很多中國(guó)沿海企業(yè)已經(jīng)受到來(lái)自企業(yè)社會(huì)責(zé)任標(biāo)準(zhǔn)SA8000的檢查,SA8000標(biāo)準(zhǔn)以及行業(yè)生產(chǎn)守則的推行更使勞動(dòng)者權(quán)益保護(hù)成為企業(yè)社會(huì)責(zé)任的核心。目前,我國(guó)外出務(wù)工的農(nóng)民工數(shù)量不斷增加,農(nóng)民工已經(jīng)成為企業(yè)重要的勞動(dòng)力資源,但是他們?cè)谄髽I(yè)的工資待遇和工作環(huán)境卻不容樂(lè)觀,很多企業(yè)出現(xiàn)了諸如工資水平低、拖欠工資、安全生產(chǎn)事故頻發(fā)等問(wèn)題,嚴(yán)重?fù)p害了農(nóng)民工權(quán)益,而學(xué)術(shù)界關(guān)于農(nóng)民工權(quán)益保障的研究集中在政府及法律制度層面,很少有學(xué)者站在企業(yè)社會(huì)責(zé)任的角度探討農(nóng)民工的權(quán)益保障問(wèn)題,基于此,本文從企業(yè)社會(huì)責(zé)任的角度認(rèn)識(shí)農(nóng)民工問(wèn)題,以期從一個(gè)不同的視野對(duì)農(nóng)民工權(quán)益保障盡一點(diǎn)綿薄之力。論文共分為五部分:論文首先梳理了企業(yè)社會(huì)責(zé)任和農(nóng)民工權(quán)益的國(guó)內(nèi)外研究現(xiàn)狀,對(duì)現(xiàn)有文獻(xiàn)進(jìn)行歸納總結(jié),發(fā)現(xiàn)現(xiàn)有研究的不足。其次,在掌握現(xiàn)有研究的基礎(chǔ)上,界定了本文的兩個(gè)核心概念"企業(yè)社會(huì)責(zé)任"和"農(nóng)民工權(quán)益",論述了企業(yè)社會(huì)責(zé)任理論中的利益相關(guān)者理論和社會(huì)契約理論,為農(nóng)民工權(quán)益保障問(wèn)題的研究提供了理論基礎(chǔ)。第三部分,通過(guò)發(fā)放和收集調(diào)查問(wèn)卷,分析了企業(yè)中農(nóng)民工權(quán)益的現(xiàn)狀,發(fā)現(xiàn)農(nóng)民工權(quán)益保障主要存在工作時(shí)間長(zhǎng)、勞動(dòng)合同簽訂率低、參保率低、勞資爭(zhēng)議無(wú)法妥善結(jié)局、職業(yè)技能培訓(xùn)少五個(gè)方面的問(wèn)題,并運(yùn)用卡方檢驗(yàn)對(duì)農(nóng)民工權(quán)益保障的個(gè)體性差異進(jìn)行了分析。第四部分,從企業(yè)、農(nóng)民工自身和政府三個(gè)層面,對(duì)制約企業(yè)對(duì)農(nóng)民工承擔(dān)社會(huì)責(zé)任的因素進(jìn)行了分析。第五部分,站在企業(yè)社會(huì)責(zé)任的角度,提出農(nóng)民工權(quán)益保障的對(duì)策建議。
[Abstract]:Migrant workers are the special product of the dual household registration system in China. Because of the imperfect system and limited education level of migrant workers, the rights and interests of migrant workers have been in a state of absence. The lack of corporate social responsibility is also an important reason for the loss of the rights and interests of migrant workers. Since the introduction of corporate social responsibility into developing countries in 1990s, for China, which is dominated by labor-intensive enterprises, The protection of labor rights and interests has seriously weakened the international competitiveness of Chinese enterprises. Many coastal enterprises in China have been inspected by SA8000, the corporate social responsibility standard, and the implementation of industry codes of practice has made the protection of workers' rights and interests the core of corporate social responsibility. The number of migrant workers has been increasing in our country. Migrant workers have become an important labor resource in enterprises, but their wages and working environment are not optimistic. Many enterprises have appeared such as low wage levels. Problems such as wage arrears and frequent accidents in production safety have seriously damaged the rights and interests of migrant workers. However, the academic research on the protection of the rights and interests of migrant workers has focused on the level of the government and the legal system. There are few scholars from the perspective of corporate social responsibility to discuss the rights and interests of migrant workers, based on this, this paper from the perspective of corporate social responsibility to understand the issue of migrant workers, The paper is divided into five parts: firstly, the paper combs the domestic and foreign research status of corporate social responsibility and migrant workers' rights and interests, and summarizes the existing literature. Secondly, on the basis of mastering the existing research, This paper defines the two core concepts of "corporate social responsibility" and "the rights and interests of migrant workers", and discusses the stakeholder theory and social contract theory in the theory of corporate social responsibility. The third part, through issuing and collecting questionnaires, analyzes the status quo of the rights and interests of migrant workers in enterprises, and finds that the protection of the rights and interests of migrant workers mainly has long working hours. There are five problems: low signing rate of labor contract, low rate of participating in insurance, unsuitable ending of labor dispute, less vocational skill training, and the use of chi-square test to analyze the individual difference in the protection of the rights and interests of migrant workers. Part 4th, from the enterprise, In this paper, the author analyzes the factors that restrict the enterprises to bear the social responsibility to the migrant workers from the three aspects of the peasant workers themselves and the government. Part 5th, from the angle of corporate social responsibility, puts forward the countermeasures and suggestions for the protection of the rights and interests of the migrant workers.
