企業(yè)社會責任視角下的農民工權益保障問題研究

【摘要】:農民工是我國二元戶籍制度的特殊產物,由于體制機制不健全以及農民工自身文化水平有限等因素,農民工權益一直處于缺失狀態(tài)。同時,企業(yè)社會責任缺失也是造成農民工權益受損的重要原因,自20世紀90年代企業(yè)社會責任傳入發(fā)展中國家以來,對于以勞動密集型企業(yè)為主的中國而言,勞工權益保護問題已經嚴重削弱了中國企業(yè)的國際競爭力,很多中國沿海企業(yè)已經受到來自企業(yè)社會責任標準SA8000的檢查,SA8000標準以及行業(yè)生產守則的推行更使勞動者權益保護成為企業(yè)社會責任的核心。目前,我國外出務工的農民工數(shù)量不斷增加,農民工已經成為企業(yè)重要的勞動力資源,但是他們在企業(yè)的工資待遇和工作環(huán)境卻不容樂觀,很多企業(yè)出現(xiàn)了諸如工資水平低、拖欠工資、安全生產事故頻發(fā)等問題,嚴重損害了農民工權益,而學術界關于農民工權益保障的研究集中在政府及法律制度層面,很少有學者站在企業(yè)社會責任的角度探討農民工的權益保障問題,基于此,本文從企業(yè)社會責任的角度認識農民工問題,以期從一個不同的視野對農民工權益保障盡一點綿薄之力。論文共分為五部分:論文首先梳理了企業(yè)社會責任和農民工權益的國內外研究現(xiàn)狀,對現(xiàn)有文獻進行歸納總結,發(fā)現(xiàn)現(xiàn)有研究的不足。其次,在掌握現(xiàn)有研究的基礎上,界定了本文的兩個核心概念"企業(yè)社會責任"和"農民工權益",論述了企業(yè)社會責任理論中的利益相關者理論和社會契約理論,為農民工權益保障問題的研究提供了理論基礎。第三部分,通過發(fā)放和收集調查問卷,分析了企業(yè)中農民工權益的現(xiàn)狀,發(fā)現(xiàn)農民工權益保障主要存在工作時間長、勞動合同簽訂率低、參保率低、勞資爭議無法妥善結局、職業(yè)技能培訓少五個方面的問題,并運用卡方檢驗對農民工權益保障的個體性差異進行了分析。第四部分,從企業(yè)、農民工自身和政府三個層面,對制約企業(yè)對農民工承擔社會責任的因素進行了分析。第五部分,站在企業(yè)社會責任的角度,提出農民工權益保障的對策建議。
[Abstract]:Migrant workers are the special product of the dual household registration system in China. Because of the imperfect system and limited education level of migrant workers, the rights and interests of migrant workers have been in a state of absence. The lack of corporate social responsibility is also an important reason for the loss of the rights and interests of migrant workers. Since the introduction of corporate social responsibility into developing countries in 1990s, for China, which is dominated by labor-intensive enterprises, The protection of labor rights and interests has seriously weakened the international competitiveness of Chinese enterprises. Many coastal enterprises in China have been inspected by SA8000, the corporate social responsibility standard, and the implementation of industry codes of practice has made the protection of workers' rights and interests the core of corporate social responsibility. The number of migrant workers has been increasing in our country. Migrant workers have become an important labor resource in enterprises, but their wages and working environment are not optimistic. Many enterprises have appeared such as low wage levels. Problems such as wage arrears and frequent accidents in production safety have seriously damaged the rights and interests of migrant workers. However, the academic research on the protection of the rights and interests of migrant workers has focused on the level of the government and the legal system. There are few scholars from the perspective of corporate social responsibility to discuss the rights and interests of migrant workers, based on this, this paper from the perspective of corporate social responsibility to understand the issue of migrant workers, The paper is divided into five parts: firstly, the paper combs the domestic and foreign research status of corporate social responsibility and migrant workers' rights and interests, and summarizes the existing literature. Secondly, on the basis of mastering the existing research, This paper defines the two core concepts of "corporate social responsibility" and "the rights and interests of migrant workers", and discusses the stakeholder theory and social contract theory in the theory of corporate social responsibility. The third part, through issuing and collecting questionnaires, analyzes the status quo of the rights and interests of migrant workers in enterprises, and finds that the protection of the rights and interests of migrant workers mainly has long working hours. There are five problems: low signing rate of labor contract, low rate of participating in insurance, unsuitable ending of labor dispute, less vocational skill training, and the use of chi-square test to analyze the individual difference in the protection of the rights and interests of migrant workers. Part 4th, from the enterprise, In this paper, the author analyzes the factors that restrict the enterprises to bear the social responsibility to the migrant workers from the three aspects of the peasant workers themselves and the government. Part 5th, from the angle of corporate social responsibility, puts forward the countermeasures and suggestions for the protection of the rights and interests of the migrant workers.
